湛江市中小学编外教师权益保障的研究

【摘要】:由于我国事业单位体制的不完善和我国教育的客观需要,在公立学校,尤其广大中小学,编外教师的聘用已经屡见不鲜了。编外聘用教师以种种名称(如:聘用教师或合同教师)在现实生活中普遍存在。与在编教师相比,编外聘用教师(聘用教师或代课教师)的身份比较复杂,在待遇、晋升、培训等权益方面处于劣势。编外编内同工不同酬,全国各地的编外聘用教师几乎毫无例外与人事编制以及相关政策绝缘,编外聘用教师的权益保障问题亟待解决。研究编外聘用教师权益保障问题无疑具有重要的理论和现实价值。本文试图采用文献法、访谈法和对比研究,通过对湛江市中小学校的个案剖析,探讨编外聘用教师的合法权益和保障问题。论文整体结构如下。第一章主要分析选择课题的背景,针对现行聘任制实施过程中,中小学编外教师权益保障存在的问题提出自己的看法,对论文写作过程中参考过的文献进行综述,表述研究的内容和研究方法,以及教师聘任制实施的预期研究成果。第二章主要对与教师聘任制有关的基本概念进行界定,梳理相关理论,并对我国聘任制下中小学教师权益保障存在的问题及原因进行探析。第三章主要介绍国外教师的权益如何得以保障和对我国的启示。第四章主要是通过社会调查实证,探析湛江市中小学编外聘用教师权益保障的实施现状及内外环境,剖析其问题所在。第五章为缩短编内编外教师的差距,提出编外聘用教师权益保障的解决措施。第六章对编外聘用教师权益保障做出总结以及给出展望。
[Abstract]:Due to the imperfect system of public institutions and the objective needs of education in our country, the employment of teachers outside the staff is common in public schools, especially in primary and secondary schools. Teachers employed outside the staff by various names (such as: hired teachers or contract teachers) are common in real life. Compared with the teachers in the staff, the status of the teachers employed outside the staff (hiring teachers or substitute teachers) is more complicated, and they are at a disadvantage in the rights and interests of treatment, promotion, training and so on. There are different pay for the same work in the outside series. Teachers employed outside the staff almost without exception are insulated from the personnel establishment and related policies. The protection of the rights and interests of the teachers employed outside the staff should be solved urgently. It is undoubtedly of great theoretical and practical value to study the protection of teachers' rights and interests. This paper attempts to discuss the legal rights and interests and protection of teachers employed by teachers in Zhanjiang through the analysis of cases of primary and middle schools in Zhanjiang by means of literature, interview and comparative study. The whole structure of the thesis is as follows. The first chapter mainly analyzes the background of the selection of topics, puts forward his own views on the problems existing in the protection of the rights and interests of non-editorial teachers in primary and secondary schools during the implementation of the current employment system, and summarizes the literature that has been referred to in the process of writing the thesis. The contents and methods of the research, as well as the expected research results of the implementation of the teacher appointment system are described. The second chapter mainly defines the basic concepts related to the appointment system of teachers, combs the relevant theories, and analyzes the problems and causes of the protection of the rights and interests of primary and secondary school teachers under the employment system in China. The third chapter mainly introduces how the foreign teachers' rights and interests are protected and the enlightenment to our country. The fourth chapter is mainly through the social investigation, analyzes the Zhanjiang primary and secondary schools outside the employment of teachers' rights and interests of the implementation of the status quo and the internal and external environment, analyzes its problems. The fifth chapter is to shorten the gap between non-staff teachers in the series, and put forward the measures to guarantee the rights and interests of teachers employed outside the staff. The sixth chapter summarizes the protection of teachers' rights and interests and gives the prospect.
