【摘要】：伴随2010年中国特色社会主义法律体系的完成,配套立法的法学研究及立法实践正方兴未艾。在我国现行有效的法律中,有182部法律要求制定配套立法,涉及共641项条款,有664件配套立法文件要求相应的主体进行配套。然而,配套立法除存在完成率不高的同时,还存在制定期限较长等问题。其中,很重要的原因是立法理念僵化、缺乏配套立法期限的规范制度。配套立法的期限研究是探究和和解决配套立法问题的重要内容和关键节点。重视我国配套立法的期限研究,完善配套立法期限的制度建设,才能最终解决配套立法症结问题。
[Abstract]:With the completion of the legal system of socialism with Chinese characteristics in 2010, the legal research and legislative practice of the supporting legislation are in the ascendant. In the current effective laws of our country, 182 laws require the enactment of supporting legislation, involving a total of 641 articles. There are 664 supporting legislative documents which require the corresponding subjects to complete them. However, in addition to not having a high completion rate, there are also problems such as a long time limit for the formulation of the supporting legislation. Among them, the very important reason is that the legislative concept is rigid. The research on the duration of supporting legislation is an important content and key node to explore and solve the problems of supporting legislation. We attach importance to the study of the duration of supporting legislation in our country, and perfect the system construction of supporting legislative period. In order to solve the problem of supporting legislation finally.
