【摘要】：中国古代的王权制约制度是中国古代法律的特色,它在一定程度上限制了王权的滥用,弥补了制度的漏洞,延缓了专制王朝的衰亡。《周礼》是中国儒家学说的经典之作,该书中包含着丰富的王权制约思想,这些思想通过一定的制度形式表现出来,是研究后世王权制约制度不可或缺的资料。本文的第一部分探究《周礼》中王权制约思想的立论基础,明确的官员分权理论是王权有限性的基础。第二部分归纳并分析《周礼》中体现王权限制思想的具体制度,主要包括冢宰制度、保氏制度、内外府制度以及匠人制度。通过对具体制度的分析,探究这些制度产生的背景、发展过程、具体内容以及存在的意义。第三部分,阐述《周礼》中的王权制约思想对后世法律的影响。从冢宰制度到后世相权制度、从保氏制度到后世谏官制度、从内外府制度到后世的财政制度、从匠人制度到后世的皇城建制,在《周礼》中体现王权制约思想之制度的影响之下,中国古代限制王权的法律制度逐渐成熟。本文力图总结《周礼》中体现王权制约思想的制度,揭示其在后世的发展演变,在回首历史的同时,为当今社会提供一些启示。
[Abstract]:The restriction system of Wang Quan in ancient China is the characteristic of ancient Chinese law. To a certain extent, it restricted the abuse of Wang Quan, made up the loopholes of the system, and delayed the decline of the autocratic dynasty. [Zhou Li] is a classic work of Chinese Confucianism. The book contains a wealth of Wang Quan's restrictive thoughts, which are manifested in certain institutional forms. The first part of this paper probes into the theoretical foundation of the restriction thought of Wang Quan in Zhou Li. The explicit theory of official decentralization is the basis of Wang Quan's finiteness. The second part induces and analyzes the specific systems that embody the restriction thought of Wang Quan in Zhou Li Li, mainly including the system of Tzuka Zai and the system of Baoshi. The internal and external government system and the craftsman system. Through the analysis of the specific system, this paper explores the background, the development process, the concrete content and the significance of the existence of these systems. The third part, This paper expounds the influence of Wang Quan's restriction thought in Zhou Li on the law of later generations. From the system of mound slaughter to the system of the power of the later generation, from the system of Baoshi to the system of remonstrating officials of the later generation, from the system of internal and external government to the financial system of the later generation, From the system of craftsmen to the imperial system of later generations, under the influence of the system of restricting Wang Quan's thought in Zhou Li, The legal system of restricting Wang Quan in ancient China has matured gradually. This paper tries to summarize the system of the restriction thought of Wang Quan in Zhou Li, reveal its development and evolution in later generations, and provide some enlightenment for the society at the same time of looking back on the history.
