【摘要】：地方立法作为中国特色社会主义法律体系的重要组成部分,是构建和谐社会的基础和保障。地方立法数量的不断增多,立法质量不高的问题也不断暴露出来,已引起了社会的广泛关注。因此,提高立法质量,是当前地方立法工作中最重要和最紧迫的课题,研究我国地方立法质量问题,着力提高地方立法质量,有助于完善中国特色社会主义法律体系,发展社会主义民主,促进经济发展,推动依法治国的进程,实现构建和谐社会的宏伟目标。立法活动或立法结果,应具有可供评价性。本文通过对地方立法活动及立法成果的研究,概括总结地方立法质量的标准,包括合法性标准、可操作性标准、技术性标准、体现地方特色标准、可持续发展标准,以期构建起科学、合理的地方立法质量评价体系。同时,本文从研究地方立法活动规律入手,归纳总结影响地方立法质量的关键因素,从地方立法主体、地方立法权限、地方立法程序、地方立法技术四个方面分析各个因素之于地方立法质量的影响。实践是检验真理的唯一标准。地方立法的实践现状是体现其质量高低的标准。我国地方立法质量存在低质化的现状,包括地方立法的形式主义(重复立法、地方特色萎缩等)、地方立法中的抵触与冲突、地方立法中的地方保护主义等。地方立法的质量就是地方立法的生命。解决我国地方立法质量存在的问题,确保地方立法充分发挥其作用,本文通过相关理论分析及对实践现状、问题的研究,尝试提出提高我国地方立法质量的途径,包括：加强地方立法主体建设、明确地方立法权限、完善地方立法程序等。
[Abstract]:As an important part of the legal system of socialism with Chinese characteristics, local legislation is the foundation and guarantee of building a harmonious society. Therefore, to improve the quality of legislation is the most important and urgent task in the current local legislative work, to study the quality of local legislation in China, and to focus on improving the quality of local legislation. It is helpful to perfect the legal system of socialism with Chinese characteristics, to develop socialist democracy, to promote economic development, to promote the process of governing the country according to law, and to realize the grand goal of building a harmonious society. Through the study of local legislative activities and legislative achievements, this paper summarizes the quality standards of local legislation, including the standards of legality, maneuverability, technology, etc. In order to set up a scientific and reasonable evaluation system of local legislation quality, this paper begins with the study of the law of local legislative activity, and summarizes the key factors that affect the quality of local legislation. This paper analyzes the influence of various factors on the quality of local legislation from four aspects: local legislative subject, local legislative authority, local legislative procedure and local legislative technology. Practice is the only criterion to test truth. The practice status of local legislation is the standard to reflect its quality. The quality of local legislation in our country is of low quality, including the formalism of local legislation. Atrophy of local characteristics, conflict and conflict in local legislation, local protectionism in local legislation, etc. The quality of local legislation is the life of local legislation. To solve the problems existing in the quality of local legislation in China, to ensure the full play of the role of local legislation, this paper through the relevant theoretical analysis and practice of the status quo, the study of problems, This paper tries to put forward some ways to improve the quality of local legislation in our country, including strengthening the construction of local legislative subjects, clarifying the local legislative authority and perfecting the local legislative procedures, etc.
