当前我国立法权异化现象分析

【摘要】：当前，我国正处于一个“大立法”的时代，立法权的正当行使也就具有了十分重要的实践意义。然而，立法权作为极其重要的公权力之一，却因为各种原因而发生了异化，从而偏离了正当行使的轨道。因为立法权归属者和行使者的分离，当立法权在行使过程中即使发生了异变，其真正的享有者未必能够得知或者有能力阻止，所以立法权的异化现象在我国并没有得到普遍关注。但是，立法权异化在现实生活中却一直隐形存在着，它的存在不利于社会的发展，不利于法治建设的进行，更是严重侵害了广大人民群众的权益，因此这个问题亟待研究并需要迅速得到规范。本文以立法权的解析为切入口，对立法权异化现象作了全面分析，阐明立法权异化就是指在立法权行使过程中，其性质发生变异而偏离权力的设立宗旨，成为个别人或个别集团谋取私利的工具，异变为损害公共利益的力量，并将立法权异化与其他相关概念进行了辨析。随后笔者结合我国的实际情况，阐述了立法权异化的主要表现形式。立法作为社会正义的第一道堤坝，是法治长城的重要基石。立法权异化现象势必会对社会正义和法律的尊严造成难以估量的戕害，除了会极大地损害人民的合法利益以外，还会阻碍我国法治建设的顺利发展，妨碍执法活动的有效开展。立法权异化之所以会出现，是因为不仅有利益的驱动及立法权限划分的不明确，还包括立法监督制度的缺失和公众参与立法的不足。为此，笔者在深层剖析当前我国立法权异化现象的基础上，从我国实际情况出发，从实体方面到程序方面，从事前预防到事后监督提出了可行性较高并有利于实现民主立法的各项防治措施，，以期在现有研究的基础上提供相关参考，确保立法权的行使有望回归到正确的运行机制。
[Abstract]:At present, our country is in the era of "big legislation", and the proper exercise of legislative power has very important practical significance. However, as one of the most important public powers, legislative power has been alienated for various reasons. This deviates from the track of proper exercise. Because the separation of the legislative power from the one who exercises it, when the legislative power is exercised differently, its true holders may not be able to know or have the ability to stop it. Therefore, the phenomenon of alienation of legislative power has not received universal attention in our country. However, the alienation of legislative power has always been invisible in real life, and its existence is not conducive to the development of society and the construction of the rule of law. It is a serious violation of the rights and interests of the masses, so this problem needs to be studied and regulated quickly. Taking the analysis of legislative power as the entry point, this paper makes a comprehensive analysis of the phenomenon of alienation of legislative power, and clarifies that the alienation of legislative power means that the nature of the alienation of legislative power changes and deviates from the purpose of establishment of power in the process of exercising legislative power. As a tool for individuals or groups of individuals to pursue their own interests, it has changed into a force that harms the public interest, and the alienation of legislative power has been differentiated from other relevant concepts. Then the author combines the actual situation of our country, and analyzes the dissimilation of legislative power from other relevant concepts. This paper expounds the main manifestation of the alienation of legislative power. As the first dyke of social justice, legislation is an important cornerstone of the Great Wall ruled by law. The phenomenon of alienation of legislative power will inevitably cause incalculable harm to social justice and the dignity of law. In addition to greatly harming the legitimate interests of the people, it will also hinder the smooth development of the construction of the rule of law in our country and hinder the effective development of law enforcement activities. This is because there is not only interest driving and unclear division of legislative authority, but also the absence of legislative supervision system and the insufficiency of public participation in legislation. Therefore, based on the deep analysis of the alienation of legislative power in our country, Proceeding from the actual situation of our country, from the substantive aspect to the aspect of procedure, this paper puts forward various preventive measures which are feasible and conducive to the realization of democratic legislation, in order to provide relevant references on the basis of the existing research. Ensure that the exercise of legislative power is expected to return to the correct operating mechanism.
