法治知识:从法学院到法院的转变

【摘要】：尽管法治中国建设已经成为共识,但是,当代中国的法治知识仍处于分裂状态:法学院里流行的法治知识不同于法院中流行的法治知识。法学院里生长的法治知识侧重应然性,侧重描述法治的理想图景。法院里盛行的法治知识侧重实然性,具有强烈的实用主义品性。在两种相异的法治知识之间,与其让法院里的法治知识靠近法学院里的法治知识,还不如让法学院的法治知识更多地靠近法院里的法治知识。当然,两种法治知识也可以互不迁就,互不迁就的法治知识格局既有其正面意义,也有其不容忽视的弊端。当前,即使在司法改革进一步推进的背景下,两种法治知识能否融会贯通仍是一个悬而未决的问题。
[Abstract]:Although the rule of law Chinese construction has become a consensus, but the rule of law is still in the knowledge of contemporary China Division: popular law school of law knowledge is different from the popular law court knowledge. The Law School of law ought to be focused on the growth of knowledge, focuses on the description of the rule of law to the rule of law prevails in the picture. The court focused on practical knowledge with strong character, pragmatism. Between the two different legal knowledge, rather than let the court of law knowledge near the law school law knowledge, also let the Law School of law knowledge more close to the method in law knowledge. Of course, the two rule of knowledge can not accommodate the pattern of rule of law, mutual knowledge not to have their positive significance, also has its drawbacks can not be ignored. Nowadays, even in the judicial reform to further promote the background, two kinds of legal knowledge can mastery is a An unresolved question.
