晚清时期中国对万国公法的理解及其运用

【摘要】：西方国际法的译介，既是西学东渐的重要内容之一，也是中国国际法学研究的一个领域，从中可以看出中西关系的变动情况。《万国公法》既是一本书名，也是19世纪末中国对西方国际法的称呼。丁韪良将美国著名法学家惠顿的著作Elements of International Law于1962年译成中文，是所有国际法译本中的典型案例。这本书1864年得到总理衙门的资助以《万国公法》为题刊行，让中国人对当时的国际形势，世界新秩序、新情况以及新价值体系有了重新认识和理解。藩属国丧失、国门被炸开等一系列挫败，使中国开始自觉不自觉把握国际秩序的原则以图自保，进而希冀改革中国社会旧有的政治、社会、经济制度，将不平等条约废除，重建独立的主权国家，，争取与西方列强在国际社会上有同等的地位。目前学界对于清末《万国公法》等西方国际法的研究成果颇丰，但对清末具体事件中如何理解和运用国际法以及地方官员对国际法如何应用仍有继续研究的空间。本文分析了以《万国公法》的传播发展，尤其侧重20世纪初在国家层面涉外事件以及地方官员在辖区处理日常涉外纠纷中的理解与运用，力图从具体事件的处理,展现官方对国际法的运用及其影响。
[Abstract]:The translation and introduction of western international law is not only one of the important contents of the eastward evolution of western studies, but also a field of Chinese international legal research. From this, we can see the changes in the relations between China and the West. "Public Law of all Nations" is both a book title. It was also the name of Western international law in China at the end of the 19 th century. Elements of International Law, a famous American jurist, was translated into Chinese in 1962, which is a typical case in all translations of international law. This book was published in 1864 under the title of "Public Law of all Nations" with the aid of the Premier Yamen, which made the Chinese have a new understanding of the international situation, the new world order, the new situation and the new value system at that time. A series of defeats, such as the loss of a subordinate state and the explosion of its borders, made China begin to consciously and unconsciously grasp the principles of the international order in an attempt to protect itself, thus hoping to reform the old political, social and economic systems of Chinese society and abolish unequal treaties. To rebuild an independent sovereign state and strive for the same status as the Western powers in the international community. At present, scholars have done a lot of research on western international law, such as "Public Law of all Nations" in the late Qing Dynasty, but there is still room for further study on how to understand and apply international law in the specific events of the late Qing Dynasty and how to apply it to local officials. This paper analyzes the spread and development of "Public Law of all Nations", especially focusing on the understanding and application of foreign affairs at the national level at the beginning of the 20th century and the understanding and application of local officials in dealing with daily disputes involving foreign affairs in the jurisdiction, in order to deal with the specific events. To demonstrate the official use of international law and its influence.
