【摘要】：卡多佐法官是20世纪美国最伟大的法官之一，他在任期间是美国从自由资本主义向垄断资本主义的转型时期，以前的先例和司法方法难以解决新时期出现的大量案件，迫切需要一种新的司法方法理论来应对这些新问题。卡多佐法官根据自己多年律师和法官的从业经验，从实践和理论的角度对司法的过程进行了敏锐、透彻的分析，探讨了司法过程中的性质、法律的成长、法律的功能和目的等问题，并在此的基础上形成了自己的司法方法理论。在卡多佐司法方法理论中，最重要的就是社会学方法，，本文写作的目的，在于通过对卡多佐司法社会学方法的研究，分析司法社会学方法在美国司法实践中的影响，从而去发现法官在具体案件的判断中要受哪些因素的左右。本文第一部分首先通过对卡多佐法官生平以及《司法过程的性质》的概述，分析和论述了卡多佐司法方法理论形成的历史背景。其次归纳了卡多佐司法方法理论中的哲学方法、历史的方法以及习惯等方法的内容。本文第二部分首先介绍了卡多佐司法社会学方法的含义和内容。并对影响司法社会学方法的正义、自由、社会观念等各种因素进行了论述。最后通过司法社会学方法产生的理论背景，论证了卡多佐其他几种司法方法与社会学方法之间的内在联系。第三部分通过对卡多佐司法社会学方法价值的介绍，说明社会学方法在法官适用法律过程中的积极意义和作用。卡多佐不仅提出了他的司法社会学方法理论，而且把社会学方法运用于自己审判的案件中。本文最后一部分介绍了社会学理论在宪法和私法领域的具体运用。
[Abstract]:Judge Cardoso was one of the greatest judges in the United States in the 20th century. He was in office during the transition period from liberal capitalism to monopoly capitalism. There is an urgent need for a new theory of judicial methods to deal with these new problems. Judge Cardoso, based on his years of experience as a lawyer and judge, made a keen and thorough analysis of the judicial process from the point of view of practice and theory, and discussed the nature of the judicial process and the growth of the law. On the basis of the function and purpose of law, the author formed his own theory of judicial method. In the theory of Cardoso's judicial method, the most important one is the sociological method. The purpose of this paper is to analyze the influence of the method of judicial sociology in American judicial practice through the research of Cardoso's method of judicial sociology. In order to find the judge in the judgment of specific cases to be affected by what factors. In the first part of this paper, the author analyzes and discusses the historical background of Cardoso's theory of judicial method by summarizing the life of Judge Cardoso and the Nature of Judicial process. Secondly, it summarizes Cardoso's philosophical method, historical method and habit. The second part first introduces the meaning and content of Cardoso's method of judicial sociology. It also discusses various factors affecting the methods of judicial sociology, such as justice, freedom, social concept, etc. Finally, through the theoretical background of judicial sociology method, the paper demonstrates the internal relation between Cardoso's other judicial methods and sociology methods. The third part introduces the value of Cardoso's method of judicial sociology, and explains the positive significance and function of sociology method in the process of judge's application of law. Cardoso not only put forward his theory of the method of judicial sociology, but also applied it to the cases he tried. The last part of this paper introduces the application of sociological theory in the field of constitution and private law.
