传统中的变革与变革中的传统——德国宪法法院的诞生

【摘要】：德国联邦宪法法院是当今世界最成功的宪法实施机构之一,在宪法学界被视为"集中式合宪性审查"模式的典范。在其六十多年的历史中,德国宪法法院用自己的实践回答了"谁是宪法的守护者"这个魏玛时代遗留下来的重大问题。德国宪法法院丝毫也不回避宪法所具有的政治和法律双重属性,但它坚持把政治问题带入到基本法的文本结构之中来考量,发展出了一套独特的从文本中发现价值、以价值来统摄文本的宪法解释方法。本文通过考察德国宪法法院奠基时期(1951—1955)巩固自身宪法地位的举措和两个关键案例,分析了宪法有效实施所需要的基本条件。
[Abstract]:The German Federal Constitutional Court is one of the most successful constitutional institutions in the world today. It is regarded as a model of "centralized constitutional review" in the constitutional circle. In its more than 60 year history, the German Constitutional Court has used its own practice to answer "who is the guardian of the constitution", a major issue left over by the Weimar era. The court of law does not evade the dual nature of the Constitution and the constitution, but it insists on taking the political issues into the text structure of the basic law and developing a unique set of constitutional interpretation methods to discover value and value the text from the text. This article examines the foundation period of the German Constitutional Court (195 1 - 1955) measures to consolidate their constitutional status and two key cases, and analyze the basic conditions for the effective implementation of the constitution.
