我国社会主义法治的正义基础研究

【摘要】：“什么是社会主义法治？怎样建设社会主义法治国家？”这两大基本问题是本文研究的根本出发点。本文通过对法治的基础性研究发现，法治与正义有着密切联系。法治社会的直接价值是形成有利于社会生产和生活的法律秩序。我国建设社会主义法治国家的直接目的也是为了建立社会主义的法律秩序。除了追求良好稳定的社会秩序，法治最根本的目的是追求法治背后的社会正义。根据法治所建立的社会制度的不同，法治可以划分为社会主义法治和资本主义法治。虽然不同社会制度下的法治所期望实现的法律秩序都是相同的，但是稳定的秩序下所追求的社会正义却有着本质性的差别。我国社会主义法治是建立在社会主义制度的基础上，法治所追求的正义是社会主义社会的正义，不同于西方资本主义国家所追求的资本主义社会的正义。因此，本文希望通过对社会主义法治的正义基础研究，探索社会主义法治所应追求的社会正义原则以及建设社会主义法治国家所需的机构正义和个人正义，为我国建设社会主义法治国家提供理论的支持。文章主要从社会、个人及机构三个维度论证分析社会主义法治建设的正义基础。文章的前言部分简要地论述了研究“社会主义法治的正义基础”原因和背景。文章正文部分一共分为三个章节：第一章是社会主义社会的正义原则，，本文将社会主义社会的正义原则分为安全原则、自由原则和平等原则，三个原则分作三节来进行论述，主要是说明为什么是这些原则以及这些原则的具体内涵。社会主义正义原则是我国社会主义法治建设的总体价值导向。第二章是法治国家的机构正义，该章主要从法治运行过程中机构的行为正义问题进行研究。公共权力机构的正义为国家权力机构正确的行使职权提供价值的标准和原则，确保权力的运行有利于社会主义社会正义的实现。第二章共分为三个小节，分别从立法机构、行政机构与司法机构三个方面研究各机构的正义。本文的第三章是法治社会中的个人正义的问题，提出法治社会下的个人正义是实践法律。本文通过三章的论述构建出了我国社会主义法治的正义观。
[Abstract]:"What is the socialist rule of law? How to build a socialist country under the rule of law?" these two basic issues are the fundamental starting point of this study. Through the basic research on the rule of law, this paper finds that the rule of law and justice have a close connection. The direct value of the rule of law is to form a legal order conducive to social production and life. The direct aim of establishing a socialist country under the rule of law is also to establish a socialist legal order. In addition to pursuing a stable and stable social order, the fundamental purpose of the rule of law is to pursue social justice behind the rule of law. According to the different social systems established by the rule of law, the rule of law can be divided into socialist and capitalist rule of law. However, the legal order expected by the rule of law under different social systems is the same, but the social justice pursued under the stable order is essentially different. On the basis of the socialist system, the rule of law is the justice of the socialist society, which is different from the western capital. Therefore, this article hopes to explore the principle of social justice that the socialist rule of law should pursue and the institutional justice and personal justice needed to build a socialist country under the rule of law through the research on the just basis of the socialist rule of law, and to provide the reason for the construction of a socialist country under the rule of law. The article mainly from three dimensions of society, individual and organization to demonstrate and analyze the just foundation of the construction of socialist rule of law. The preface of the article briefly discusses the reasons and background of the study of the just basis of the "socialist rule of law". The text part is divided into three chapters: the first chapter is the justice of the socialist society In principle, this article divides the principles of justice of socialist society into security principle, freedom principle and equality principle, and divides the three principles into three sections. The main reason is to explain why these principles and the concrete connotations of these principles are the overall value orientation of the socialist rule of law in China. The second chapter is the principle of socialist justice. It is the institutional justice of the rule of law. The chapter mainly studies the behavior justice of the institutions in the course of the rule of law. The justice of the public authority provides the standards and principles for the correct exercise of power by the state power institutions, and the operation of power is beneficial to the realization of the socialist social justice. The second chapter is divided into three small parts. The third chapter of this article is the question of the individual justice in the rule of law society, and the individual justice under the rule of law is the practical law. This article constructs the justice view of the socialist rule of law in China through the discussion of the three chapters.
