【摘要】：《中华苏维埃共和国宪法大纲》是中国历史上首部体现人民当家做主的宪法,它与后来社会主义宪政有着深厚的历史渊源,具有时代开创性。《宪法大纲》是马克思主义宪政中国化的一次伟大实践,对中国宪政模式和实践都产生深远的历史影响。中华人民共和国的历次宪法,无不以《宪法大纲》为蓝本,大纲的理念、范式及其内容已经深深地植入中国当代政治实践中。《宪法大纲》的产生具有一定的历史必然性,它是中国苏维埃运动的产物,是中共中央、中央苏区及各根据地交互影响作用下的产物。它的内容十分丰富,总共有十七条,主要包括规定中华苏维埃共和国的政权性质、各项基本政治制度、工农民主专政的任务、公民的民主权利以及提出民族自由权等方面内容。这些内容构成了苏维埃政权对内对外政策的基础,是苏维埃宪政的根本保证。同时,《宪法大纲》确立的人权保障原则深刻地影响着中国的革命进程以及建国后的制宪运动,是新中国人权入宪的重要历史渊源。以《宪法大纲》的文本为切入点,对中央苏区时期的苏维埃模式加以详细考辨和深入分析,不但具有较高学术价值,而且还有重大的现实意义。
[Abstract]:The outline of the Constitution of the Soviet Republic of China is the first constitution in Chinese history that embodies the people as the master of their own country. It has a profound historical origin with the later socialist constitutionalism. The outline of the Constitution is a great practice of the Sinicization of Marxist constitutionalism, which has far-reaching historical influence on the constitutional model and practice of China. All previous constitutions of the people's Republic of China have been based on the outline of the Constitution, the ideas, paradigms and contents of the outline have been deeply embedded in the contemporary political practice of China. The emergence of the outline of the Constitution has a certain historical inevitability. It is the product of the Chinese Soviet movement and the interaction of the CPC Central Committee, the Central Soviet region and various base areas. It contains 17 articles, including the nature of the political power of the Soviet Republic of China, the basic political system, the tasks of the democratic dictatorship of workers and peasants, the democratic rights of citizens and the right to put forward the right to national freedom. These contents constitute the basis of Soviet regime's internal and foreign policy and the fundamental guarantee of Soviet constitutionalism. At the same time, the principle of human rights protection established in the outline of the Constitution profoundly affects the revolutionary process of China and the constitution-making movement after the founding of the people's Republic of China, which is an important historical origin of the entry of human rights into the Constitution of the people's Republic of China. Taking the text of the outline of the Constitution as the starting point, this paper makes a detailed study and analysis of the Soviet model in the period of the Central Soviet region, which is not only of high academic value, but also of great practical significance.
