地方立法监督程序的体系完善

【摘要】:立法监督是我国依法治国、完善立法的一种重要手段和措施,它的存在是在于保障立法的公平、正义,避免和预防立法权滥用或立法权闲置的问题出现,维护立法的权益、促进立法水平、提高立法质量。但现实情况中法律规定的稀少与缺失,使立法监督特别是地方立法监督程序的实施缺少可参照的依据,影响了立法监督的有效实施。本文在对我国目前的立法监督程序情况及完善立法监督程序的重要性进行介绍后,对学界关于立法监督的三种不同分类进行了详细论述,并就其中关于立法监督程序结构设计的分类加以详述,论述该结构体系中可能存在的缺点与不足并提出自己的改进观点。 地方立法监督的启动程序是立法监督的开端,它开启了立法监督的序幕,为立法监督的开始提供了依据和参考。地方立法监督启动需要一定的主体,依照我国相关法律、法规规定及法理原理,文章讨论出能够的启动立法监督的主体较为广泛。有主体就要有相应的监督对象,在我国地方立法各具特色,因此立法监督的对象也是种类繁多、形式各异。任何权利的行使都是应当受到一定限制与设定的,立法监督权也如此,立法监督主体的监管范围也应确定,不加限量会导致立法监督权交叉混同,造成权利实现困难或是权利分配不均,出现权利使用不当及滥用。立法监督的行使还应当有时间的限定,而非可以任意进行,针对不同监督主体时有自身的时间设置,就同一种主体而言也要适用法律的相关规定。 地方立法监督的实施程序是立法监督的重要阶段也是实质进行的过程,对立法的有效实现有着致关重要的作用。此阶段的立法监督程序主要涉及对立法内容的合法性、合理性审查,合法性是立法的基础,只有在法定权限之内所立之法,不存在矛盾抵触情况,才能使订立的法律、法规得以实施。实施地方立法监督的方式和手段主要包括批准、备案、审查和清理,并以撤销权为保障措施,有效保证立法监督的真正实现。立法监督的行使不应盲目而无节制,它的实施过程中要有一定的期限限制,在设立的时限中得出相关的监督结论为下一步的立法监督结果付出实践提供依据和支持。 地方立法监督的执行程序是对立法监督实施过后得出结论的贯彻落实,是反映立法监督实效的重要程序,也起到了对立法监督结果考察纠偏的作用。执行立法监督的结论,需要有主体来实现。执行是要将立法监督主体得出结论加以落实,依照我国的法律、法规及有关地方法规的规定,执行主体利用批准通过、法定撤销或改变、有权审查、清理旧法的方法来落实立法监督的结果。监督结论的执行中有权利自然就要承担应有的责任,实现权利责任的对等,也是对行使立法监督的一种限制与再监督。有了责任,就有救济措施,这样才能真正保证立法监督结论的实现与执行。 启动、实施、执行三者相互配合、相辅相成,组成一个完整、连贯的立法监督的程序体系,为立法监督的实施提供了程序保障,用程序来支持和维护实体的进程,更好地实现我国地方立法监督的发展。
[Abstract]:Legislative supervision is an important means and measure to govern the country according to law and improve the legislation. Its existence is to guarantee the fairness and justice of legislation, to avoid and prevent the abuse of the legislative power or the idle of the legislative power, to safeguard the rights and interests of the legislation, to promote the legislative level and to improve the quality of the legislation. The implementation of legislative supervision, especially the implementation of local legislative supervision procedures, is short of reference, which affects the effective implementation of legislative supervision. After introducing the current legislative supervision procedures and the importance of perfecting the legislative supervision procedures, this paper expounds the three different categories of legislative supervision in the academic circles. In this paper, the classification of the structural design of the legislative supervision procedure is described in detail, and the shortcomings and shortcomings that may exist in the structural system are discussed and their own improvement views are put forward.
The starting procedure of the local legislative supervision is the beginning of the legislative supervision. It opens the prelude to the legislative supervision. It provides the basis and reference for the beginning of the legislative supervision. The starting of the local legislative supervision needs certain subjects. According to the relevant laws, regulations and legal principles of our country, the article discusses the main body of the legislative supervision that can be started. There should be a wide range. The subject must have the corresponding supervision object and the local legislation in our country has its own characteristics. Therefore, the object of the legislative supervision is also various and different. The exercise of any right should be restricted and set up, the legislative supervision right is also the same, the scope of the legislative supervision owners should be determined, and the unlimited quantity will lead to the establishment of the legislative supervision. The intersecting and blending of the right of legal supervision leads to the difficulty of realizing the rights or the uneven distribution of rights, and the improper use and abuse of rights. The exercise of legislative supervision should also be limited by time, but not to be carried out arbitrarily. In the case of different supervisory subjects, there should be their own time setting, and the relevant provisions of the law should also be applied to the same subject.
The implementation procedure of the local legislative supervision is an important stage of the legislative supervision and the substantive process, which plays an important role in the effective realization of the legislation. The legislative supervision procedure at this stage mainly involves the legality of the legislative content, the rationality examination, the legitimacy as the basis of the legislation, and the law which is established within the legal authority, There is no contradiction between conflict and conflict in order to make the laws and regulations put into practice. The ways and means to implement the supervision of local legislation include approval, filing, examination and cleaning, and the real realization of the legislative supervision with the right of revocation as the guarantee. The exercise of legislative supervision should not be blind and unrestrained, and the process of its implementation should be carried out. There are certain time limits, and relevant supervisory conclusions can be drawn up in the time limit set up to provide the basis and support for the practice of the next legislative supervision.
The implementation procedure of the local legislative supervision is the implementation of the conclusion after the implementation of the legislative supervision. It is an important procedure to reflect the actual effect of the legislative supervision. It also plays a role in rectifying the results of the legislative supervision. The conclusion of the implementation of the legislative supervision needs to be realized by the main body. In accordance with the laws, regulations and relevant local laws and regulations of our country, the executive subject has the right to examine and clean up the old law to implement the result of legislative supervision by means of approval pass, legal revocation or change. A kind of restriction and re supervision of the governor. If there are responsibilities, there are relief measures, so as to truly guarantee the realization and implementation of the conclusion of legislative supervision.
Starting, implementing, implementing and complementing each other, complementing each other, forming a complete and coherent procedural system of legislative supervision, providing procedural safeguards for the implementation of legislative supervision, supporting and maintaining the process of the entity with procedures, and better realizing the development of local legislative supervision in China.
