论民国时期边疆司法改革原则——以西康司法改革为例

【摘要】：二十世纪三十年代,中国的边疆形势十分严峻。尤其是抗日战争爆发后,边疆危机进一步加深,边疆民族问题受到社会各界的普遍关注。为了维护西康地区的社会稳定,发挥其抗战建国功能,西康省政府成立司法筹备处,对西康省司法制度进行了改革。司法改革依循强化民族平等、注重国家法与习惯法的调适等原则,既保证了国家法制的统一适用,又充分尊重民间风俗习惯,使国家法令得以有效运行。
[Abstract]:In the 1930's, China's frontier situation was very serious. Especially after the War of Resistance against Japan broke out, the border area crisis deepened further, the frontier nationality question received the universal attention of all walks of life. In order to maintain the social stability of Xikang region and give full play to its function of establishing a nation during the War of Resistance against Japan, the Xikang Provincial Government set up a judicial preparatory office to reform the judicial system of Xikang province. The judicial reform adheres to the principles of strengthening national equality and paying attention to the adjustment of national law and customary law, which not only ensures the unified application of the national legal system, but also fully respects the folk customs and habits, and makes the state decrees run effectively.
