新农村建设中农民法制教育研究

【摘要】：新农村建设是在依法治国的时代背景下展开的,因此,建设新农村的一切行为和举措都应该以“法治”为基本决策依据。农民作为新农村建设的主体,其法律素质的高低,直接关系着新农村建设的各项目标能否顺利实现。农民法制教育是提高农民法律素质的重要途径。从1986年,我国实施普法教育规划以来,经过五个“五年普法规划”,广大农民的法律素质有了较大提高,但是与我们建设法治国家的要求相比,还有较大差距,尤其是随着我国法治进程的加快,现行的农民法制教育模式,逐渐暴露出“教育内容缺乏针对性,教育方式方法单一,制度化不强”等问题,这使其越来越难以适应新形势下农民学法、用法和新农村建设对农民法律素质的要求。通过广泛深入的调查和文献查阅,笔者发现,当前农民法制教育之所以会呈现不存不济的状态,除了与法制宣传存在的问题相关外,也跟基层政府执法行为不规范、基层法律服务缺位、村民自治制度不完善和农村民生事业落后有关系,后者对农民法律意识的影响甚至超过了前者。笔者在研究域外农民法制教育之后发现,凡是“涉农法制完备、基层自治发达、社会组织兴旺”的国家和地区,农民的法律意识都比较强。基于以上的调查和研究,结合教育学中“显性教育与隐性教育相结合”的理论,笔者将“国家、社会、农村”,视为推动农民法制教育全面进步的“三方主体”,将“健全涉农特别法体系、发展农民社会组织、完善村民自治制度、改善农村民生落后局面”等方面,视为农民法制教育的“隐性教育部分”,提出了“构建农民法制教育立体化模式”的思想。
[Abstract]:The construction of new countryside is carried out under the background of ruling the country by law. Therefore, all behaviors and measures of building new countryside should be based on "rule of law" as the basic decision-making basis. As the main body of the new rural construction, the legal quality of the peasants is directly related to the realization of the objectives of the new rural construction. Legal education of farmers is an important way to improve the legal quality of farmers. Since the implementation of the legal Popularization Education Program in China in 1986, the legal quality of the vast number of peasants has been greatly improved after the implementation of the "Five-year legal Popularization Plan", but there is still a big gap compared with our requirements for building a country ruled by law. In particular, with the acceleration of the process of rule of law in our country, the current mode of legal education for farmers has gradually exposed such problems as the lack of pertinence in the content of education, the single method and method of education, the weak institutionalization, etc. This makes it more and more difficult to adapt to the new situation of farmers to learn law, usage and new rural construction of the requirements for the legal quality of farmers. Through extensive and in-depth investigation and literature review, the author finds that the reason why the current legal education of farmers does not exist is related not only to the problems existing in legal propaganda, but also to the non-standard law enforcement behavior of grass-roots governments. The absence of legal services at the grass-roots level and the imperfection of the villagers' autonomy system are related to the backwardness of the rural people's livelihood, and the latter's influence on the peasants' legal consciousness is even greater than that of the former. After studying the legal education of peasants outside the country, the author finds that the legal consciousness of farmers is relatively strong in all countries and regions where "the agricultural legal system is complete, the grass-roots autonomy is well developed and the social organization is flourishing". Based on the above investigation and research, combined with the theory of "combination of explicit education and recessive education" in pedagogy, the author regards "country, society and countryside" as the "tripartite subject" to promote the overall progress of farmers' legal education. "perfect the system of special law concerning agriculture, develop the social organization of farmers, perfect the system of villager autonomy, and improve the backward situation of people's livelihood in rural areas" is regarded as the "recessive education part" of the legal education of farmers. This paper puts forward the idea of constructing the three-dimensional mode of farmer's legal education.
