美国刑事法律援助中的合同制度研究:成因、发展与困境

【摘要】：合同制度是美国主要的刑事法律援助实施机制,其采用政府与律师、律师事务所等个人或机构签约的形式为犯罪嫌疑人、被告人提供辩护服务。美国合同制度产生与发展的基础是贫困者辩护服务的客观需求,解决与公设辩护人办公室有关的利益冲突案件,控制法律援助成本。总体上,合同制度受到人口稀少的州或县的青睐,在贫困者辩护体系中发挥补充性作用,并由相关规范性文件指导运行。当前合同制度面临资金匮乏、合同律师案件负荷量过重、代理质量下降等困境。合同制度只有树立质量优于成本的理念,才能维护犯罪嫌疑人、被告人权利。
[Abstract]:The contract system is the main criminal legal aid enforcement mechanism in the United States, which uses the form of signing contracts with lawyers, law firms and other individuals or institutions to provide defense services to the suspects and defendants. The foundation of American contract system is the objective demand of defense services for the poor, the resolution of conflicts of interest cases related to the Office of the Public defender, and the control of legal aid costs. In general, the contract system is favored by sparsely populated states or counties, plays a complementary role in the defense system of the poor, and is run under the guidance of relevant normative documents. At present, the contract system is faced with a shortage of funds, the burden of contract lawyers is too heavy, and the quality of agency is declining. Only by establishing the concept that quality is superior to cost can the contract system safeguard the rights of suspects and defendants.
