法治中国建设进程中的五大关系

【摘要】：法治中国建设涉及法学内外,因而有必要超越单一的学科界线,从相互联系的认识论角度来理解法治中国建设。法治中国建设的理性展开,应当重点考虑五大关系,即法治建设与中国建设的关系、普适法治与具体法治的关系、形式法治与实质法治的关系、国家法律与党内法规的关系以及传统资源与外来资源的关系。同时,要有效地把握法治中国建设进程中的这五大关系,还要注意学术智慧不同于实践智慧,要看到法治中国建设主要是一个实践问题,法治中国要在实践过程中逐渐臻于完善,实践才是推动法治中国建设的根本动力。
[Abstract]:The construction of China under the rule of law involves both inside and outside the law, so it is necessary to transcend the single disciplinary boundary and understand the construction of China by law from the perspective of the interrelated epistemology. The rational development of the construction of China ruled by law should focus on five relations, namely, the relationship between the construction of the rule of law and the construction of China, the relationship between the universal rule of law and the concrete rule of law, the relationship between the formal rule of law and the substantive rule of law. The relationship between national laws and inner-party regulations and between traditional resources and foreign resources. At the same time, in order to effectively grasp these five relations in the process of building China under the rule of law, it is also necessary to pay attention to the difference between academic wisdom and practical wisdom. It is necessary to see that the construction of China under the rule of law is mainly a practical issue. China ruled by law should be perfected gradually in the process of practice, and practice is the fundamental motive force to promote the construction of China under the rule of law.
