论地方高校转型目标下“实践性”法学教育的定位及实现路径

【摘要】：法学毕业生群体就业遇冷引发对现行法学教育改革的思考,地方高校向应用技术型教育转型的大趋势下,将应用型法律人才作为法学人才培养目标,强化"实践性"法学教育是专业发展的方向。当前大陆法系经院式教学中存在着各种滞后:教师学术科研之路与人才培养实践性方向相互偏离,"填鸭式"主体教学方式对实践性法学教学目标偏离,法学课堂案例教学的格式化和程式化与案例教学效用偏离,实践性法学课程的随意化和表演化与工作实际环境偏离等。强化实践性法学教育,应针对这些问题采取一定措施:改革师资职称晋升机制、改革传统案例教学法、探索"产学研"模式等。
[Abstract]:The employment of law graduates does not meet the expectations of the current law education reform, local colleges and universities to the application of technology to the general trend of education, the application of law talent as the goal of legal talent training. Strengthening the practice of law education is the direction of professional development. At present, there are various lags in the mode of teaching in the continental law system: the way of teachers' academic research deviates from the practical direction of talent training, and the "spoon-feeding" main teaching method deviates from the goal of practical law teaching. The formatting and stylization of case teaching in law classroom deviates from the effectiveness of case teaching, and the random and performing of practical law courses deviates from the actual working environment, and so on. In order to strengthen the practical law education, some measures should be taken to solve these problems: reforming the promotion mechanism of teachers' professional titles, reforming the traditional case teaching method, exploring the mode of "production, learning and research", etc.
