再论社会与法律的关系

【摘要】：社会与法律关系密切,社会决定法律,法律因应社会。社会的自然条件、人员构成、经济基础、政治体制和文化因素与法律之间存在着深刻、具体而丰富的内在关系。自然条件有其客观必然性,蕴含着自然规律或"自然法",法律是自然规律的法律化;法律是人的行为规则,人口数量、人的属性、人员构成、社会群体、阶级阶层决定着法律,法律是各类社会成员斗争妥协的结果;经济是法律的基础,不同的经济形式决定了不同的法律内容及其特征,法律不过是经济关系的记载和表述;政治制度是法律的重要内容,法律具有鲜明的政治性,政治法治化是政治发展的主要趋势,法治是最大的政治;文化决定着法律,法律是文化的结晶,文化滋养法律,法律改良文化。社会与法律的密切关系要求人们在社会中认知法律、在法律中认知社会。
[Abstract]:Society and law are closely related. Society decides the law, and the law responds to the society. There are profound, concrete and rich internal relations between social natural conditions, personnel composition, economic base, political system and cultural factors and law. The natural condition has its objective inevitability, it contains the natural law or "natural law", the law is the legalization of the natural law, the law is the human behavior rule, the population quantity, the person's attribute, the personnel composition, the social group, the class stratum decides the law, The law is the result of all kinds of social members' struggles and compromises; the economy is the basis of the law; different economic forms determine the different legal content and characteristics; the law is but the record and expression of the economic relations; the political system is the important content of the law. Law has a distinct political character, political rule by law is the main trend of political development, the rule of law is the biggest political, culture determines the law, law is the crystallization of culture, culture nourishes the law, and law improves the culture. The close relationship between the society and the law requires people to recognize the law in the society and the society in the law.
