美国反补贴调查中的补贴认定研究

【摘要】： 在WTO法律规则中,反倾销、反补贴和保障措施是WTO允许的贸易救济措施。中国入世以来,对外贸易的发展有力的促进了经济的高速增长。但与此同时,我国所面临的贸易摩擦也逐渐增多。 2006年11月美国对中国生产的铜版纸发起第一起双反调查,截至2010年4月美国共对中国发起了25起反补贴调查。反补贴措施成为我国政府和出口企业必须面对的又一新的贸易壁垒。尤其是在金融危机的背景下,贸易保护主义有所抬头,导致了更多贸易摩擦的产生。而“中国制造”成为美国贸易保护主义的首要目标,反补贴已渐成为美国进一步遏制中国产品竞争力的重要武器。在反补贴调查中,补贴的认定是进行反补贴调查的前提,补贴的认定规则是一国反补贴法中最为重要的规则。近年来,美国频频对我国的出口产品发起反补贴调查,在这一领域积累了丰富的经验,因而我们有必要对美国反补贴法中的补贴认定规则作全面的探讨。为了能更好的认识美国反补贴措施中补贴认定这一问题,需要从最基础的概念入手,如美国反补贴法之补贴的概念和构成要件,因为概念和构成要件是反补贴法律制度的前提和基础。同时作为反补贴措施实施前提条件的专项性标准及其界定,是在论述基本概念和构成要件的基础上必须把握的另一个重要的法律问题。通过对这几个问题的研究,在此基础上结合对美国反补贴法之补贴的分类和补贴额的计算等实际问题探讨可以比较完整的掌握美国反补贴措施中补贴认定的相关内容和运作模式。对此问题的研究最终的落脚点是怎样让中国企业在对美贸易过程中面对美国反补贴措施时能更好的维护自己的权益。结合我国企业对美贸易的实际情况,可以通过制定和完善我国的补贴政策,健全我国的相关反补贴法律,以及更加灵活的运用相关法律,真正实现对我国出口企业正当利益的维护。
[Abstract]:In the legal rules of WTO, anti-dumping, countervailing and safeguard measures are the trade relief measures allowed by WTO. Since China's entry into WTO, the development of foreign trade has promoted the rapid growth of economy, but at the same time. The trade friction that our country faces also increases gradually. In November 2006, the United States launched the first double-counter investigation into Chinese coated paper. By April 2010, the United States had launched 25 countervailing investigations against China. Countervailing measures have become another new trade barrier that our government and export enterprises must face. Especially in the context of the financial crisis, trade protectionism has risen, leading to more trade frictions, and "made in China" has become the primary target of trade protectionism in the United States. Countervailing has gradually become an important weapon for the United States to further curb the competitiveness of Chinese products. In the countervailing investigation, the recognition of subsidy is the premise of countervailing investigation. The recognition rule of subsidy is the most important rule in the countervailing law of a country. In recent years, the United States frequently launched countervailing investigation on our country's export products, and accumulated rich experience in this field. Therefore, it is necessary for us to make a comprehensive discussion on the rules of subsidy recognition in American countervailing law. In order to better understand the issue of subsidy recognition in American countervailing measures, we need to start with the most basic concepts, such as the concept and constituent elements of the countervailing subsidy in the United States. Because the concept and the constituent elements are the premise and foundation of the countervailing legal system. At the same time, it is the special standard and the definition of the countervailing measures. It is another important legal problem which must be grasped on the basis of discussing the basic concepts and constitutive elements. On this basis, combining with the classification of the subsidy and the calculation of the subsidy amount of the United States countervailing law, we can fully understand the relevant contents and operation mode of the subsidy recognition in the United States countervailing measures. The final focus of the study is how to make Chinese enterprises in the process of trade with the United States to face the United States countervailing measures to better safeguard their rights and interests. Combined with the actual situation of Chinese enterprises trade with the United States. We can make and perfect the subsidy policy of our country, perfect the relevant countervailing laws of our country, and use the relevant laws more flexibly, so as to truly realize the safeguard of the legitimate interests of the export enterprises of our country.
