试论沈家本法制改革思想的实用主义倾向

【摘要】： 近代中国在现代化大潮的冲刷中产生了一个重要的文化现象,就是在人文领域集中涌现出一批大师级人物,他们往往既是传统文化的末代天王,又是领导变革的开路先锋,沈家本作为律学殿军、法学先驱无疑就是其中之一。对此,本文从沈家本的个人经历入手,对其法制改革思想的理论渊源、内在特征、主要内容、目标和方法予以探讨,并试图通过传统法律文化和西方法学思想的公分母——实用主义这一特定视角给出对上述现象的解释。
[Abstract]:In modern China, an important cultural phenomenon emerged in the tide of modernization, that is, a group of master figures emerged in the humanities field, who are often the last king of traditional culture. Shen Jiaben is also a pioneer in leading the reform. As a lawyer, the pioneer of law is undoubtedly one of them. To this end, this article starts with Shen Jiaben's personal experience and the theoretical origin of his thought of legal reform. The internal characteristics, main contents, objectives and methods are discussed, and the explanation of these phenomena is given through the common denominator of traditional legal culture and western legal thought, pragmatism.
