语境下的法治——评塔玛纳哈《论法治———历史、政治和理论》

【摘要】：什么是法治?这是个长久以来争论不休的话题。一般而言对法治的论述大体上可分为三类:"形式论述声称,法律的来源、制定与适用,必须具备一定的形式要件;实质论述主张,法律的内容,必须受某些实质要件的限制;综合论述则强调,法律的形式与实质要件不可偏废。主张法治应以形式要件为重的论点,可统称为形式法治理论,而主张以实质要件为重的论点,则称为实质法治理论。在当代西方的法政论述中,不乏对这两种理论做深入学理探讨的研究,其中尤以美国法学者塔玛纳哈所做的比较分析,最为完备周延。"[1]本文选取塔玛纳哈在《论法治——历史、政治和理论》一书中对于法治理论构想的分析为基本切入视角,结合塔玛纳哈在此基础上所总结的法治的三个共通主题,展现塔玛纳哈理论中对一般法理学与社会-法实证主义的运用。所希望着重展现的正是这样一种经由塔玛纳哈的社会-法实证分析,将法治置于历史、社会与政治语境下的理解。
