中西授权立法监督制度比较研究

【摘要】：二十世纪以来,授权立法在世界范围内得到广泛的确立和发展,成为国家立法制度的重要组成部分,也是政府加强行政管理的重要手段。授权立法的确立,一方面突破了古典宪政理论,一方面又修正了分权学说。但是由于通过授权立法政府的权力得到了不断扩张,从授权立法产生之初争议不断,受到了人民主权和宪政分权原则的质疑,因此对授权立法的监督也成为必要。在我国立法实践中,授权立法制度也得到了快速的发展。面对这一发展趋势,我国对授权立法的监控制度没有完全建立起来,在理论和实践中都产生了矛盾与混乱。对此建立对授权立法的有效监督制度成为授权立法合理有序发展的必然。本文在对授权立法的产生和发展进行论述的前提下,立足于本国的法律制度和具体国情,通过比较研究的方法解析西方国家的授权立法监督制度的理论与实践,从而对我国授权立法制度的完善提出建议。
[Abstract]:Since 20th century, the enabling legislation has been widely established and developed in the world, and has become an important part of the national legislative system and an important means for the government to strengthen its administration. On the one hand, it breaks through the classical constitutional theory, on the other hand, it modifies the theory of separation of powers. Being questioned by the principle of people's sovereignty and constitutional separation of powers, it is necessary to supervise the enabling legislation. In the legislative practice of our country, the authorized legislative system has also been developed rapidly. China's monitoring system for enabling legislation has not been fully established. There are contradictions and confusion in theory and practice. It is inevitable to establish an effective supervision system for enabling legislation to develop in a rational and orderly manner. Based on the domestic legal system and specific national conditions, this paper analyzes the theory and practice of the supervision system of authorized legislation in western countries by means of comparative study, and puts forward some suggestions for the perfection of the legislative system of authorization in our country.
