苏格拉底之死与中国语境下的法律信仰

【摘要】： 改革开放三十年来,我们的法治建设取得了长足的进步,立法数量与质量都得到了明显的提升,人们的法律意识、法治观念在逐渐增强。但是,一个不容回避的事实是,伴随着法律数量的增加,人们对法律公平正义的感觉并没有相应的增加;伴随着人们法律意识的提高,人们自觉守法的比例没有明显改善。曾几何时,美国人深夜在无人、无车、无摄像头的路口等待绿灯通行的故事,深深地震撼着我们的灵魂。许多学者认为,法律信仰的缺失是造成有法不依现象大量存在的深层次原因。法律信仰概念的提出源于美国法学家、历史学家伯尔曼《法律与宗教》中的一句名言:“法律必须被信仰,否则他形同虚设。”近年来研究与推崇法律信仰的学者越来越多,且热情有增无减。相信这种深入的研究一定会将中国的法治建设推向一个更高的阶段与层次。本文从苏格拉底之死谈起,通过界定中国语境下法律信仰的内涵,分析法律信仰缺失的表现、危害和成因,为培育中国语境下的法律信仰提供较为可行的操作建议和理论支持。
[Abstract]:In the past 30 years of reform and opening up, we have made great progress in the construction of the rule of law, the quantity and quality of legislation have been obviously improved, and people's legal awareness and concept of the rule of law have been gradually strengthened. However, it is an unavoidable fact that, With the increase in the number of laws, there has been no corresponding increase in the sense of fairness and justice in the law; with the increase in people's legal awareness, the proportion of people consciously abiding by the law has not improved significantly. The story of a car-free, camera-less intersection waiting for a green light is a deep shock to our souls. Many scholars believe that. The lack of legal belief is the deep reason why the phenomenon of law failure exists in large numbers. The concept of legal belief originated from a famous saying in the American jurist, historian Berman, Law and Religion: "the law must be believed," Otherwise, he is nothing more. "in recent years, more and more scholars have studied and respected legal beliefs," he said. It is believed that this kind of in-depth study will push the construction of the rule of law in China to a higher stage and level. This paper begins with the death of Socrates and defines the connotation of legal belief in the Chinese context. This paper analyzes the manifestation, harm and causes of the lack of legal belief, and provides more feasible operational suggestions and theoretical support for the cultivation of legal belief in Chinese context.
