关于完善我国立法机制的思考

【摘要】：完善中国特色社会主义法律体系不能仅仅着眼于法律体系自身,必须注意完善立法机制。完善立法机制涉及人大立法与常委会立法、人大立法与政府立法、中央立法与地方立法的关系,涉及完善法律解释制度等一系列问题。完善作为根本制度的人民代表大会制度,不能使常委会立法代替人大立法,不能仅从权宜出发,它关系到人民当家做主和中国特色社会主义的本质特征,必须从我国政治体制改革的顶层设计考虑。加强政府立法与地方立法是许多国家立法发展的共同趋势,与此同时必须加强对它们的法律监督,协商机制不能代替"改变和撤销机制"。要解决法律的稳定性和社会关系的变动性之间的矛盾,不能只依赖立改废机制,而必须注意发挥法律解释的作用。
[Abstract]:In order to perfect the socialist legal system with Chinese characteristics, we should not only focus on the legal system itself, but also improve the legislative mechanism, which involves the legislation of the people's Congress and the standing Committee, the legislation of the people's Congress and the legislation of the government. The relationship between central legislation and local legislation involves a series of problems, such as perfecting the system of legal interpretation. To perfect the system of people's congresses, which is the fundamental system, cannot enable the standing Committee to legislate in place of the legislation of the people's congresses. It relates to the essential characteristics of the people as the master of the country and socialism with Chinese characteristics, and must be considered from the top level of the reform of the political system of our country. Strengthening government legislation and local legislation is the common trend in the legislative development of many countries. At the same time, it is necessary to strengthen the legal supervision over them, and the consultation mechanism cannot replace the "mechanism of change and revocation"... in order to resolve the contradiction between the stability of the law and the variability of social relations, we cannot rely solely on the mechanism of reform and abolition. We must pay attention to the role of legal interpretation.
