【摘要】： 情感是心理学和社会学的研究范畴,随着社会学对情感内容、性质的不断充实和发展,使得对情感的认识渐渐地趋于理性,情感不再被简单的认为是纯粹感性的,而是可以有理性的内容,这促使了在法学领域内重新对法律与情感的关系进行更深入的分析。法律情感是公民法律观念中的一个重要内容,也是最容易被忽视甚至是被否定的一个部分,法律情感同自然情感、道德情感、宗教情感以及审美情感等其它类型的情感一样,都属于情感范畴,所不同的是引起各种情感产生的对象和各种情感的社会功能。相对于其它的情感类型,法律情感是法治社会的精神依托,法律情感是作为社会主体的公民对法律制度,法律现象等与法律有关的所有问题的心理价值体验和主观态度,它不仅仅是个人情感的问题,更是有着关乎整个社会的集体情感的重要意义。公民的法律情感有正负之分,公民对法律要么满意要么排斥要么漠不关心,而这些其实都是法律情感的集中表现。在中国的法治实践中公民对法律本身和司法结果的不满和不屑等负面的法律情感有增长的趋势,其社会影响比较严重的,因此培育公民的正面法律情感是必要的且迫切的。全文分为四个部分：第一部分在对情感问题理论的分析基础上对公民的法律情感的概念进行梳理、分析和总结,并且对与公民的法律情感有关的相关概念进行比较,突出公民法律情感的特点和重要性,最后指出公民法律情感一般意义上的内容。第二部分从历史、社会、法律自身、公民自身和法治实践五个方面对影响公民法律情感生成的因素进行阐述。法律情感是公民法律观念中的一部分,因此深受法律文化的影响,同时随着经济社会的发展而不断的变化和丰富,法律的不断完善,以及公民素质的提升都会直接影响法律情感的内容和性质,法治实践的结果直接反映着公民法律情感的状态,各个因素之间相互影响、相互推进,共同影响法律情感的形成。第三部分,强调法律情感之于法的重要意义的最终目的是在发展和完善现代法律制度的同时通过对公民法律情感的培养来加速公民法律观念的现代化,从而推动中国法制现代化进程,因此,针对前部分的各个影响因素提出了培育公民的法律情感的几种途径。第四部分,公民的法律情感在不同的国度、不同的时代、不同的社会发展阶段都有着不同的内容和侧重点,对于现阶段的中国法治而言,需要一种普遍信任的法治情感作为其社会根基,这是中国现实国情所真正需要的精神意蕴。因此在文章最后阐述了普遍信任之于中国法治的重要性。
[Abstract]:Emotion is the research category of psychology and sociology. With the constant enrichment and development of the content and nature of emotion in sociology, the understanding of emotion gradually tends to be rational, and emotion is no longer simply considered to be pure sensibility. But it can have rational content, which urges a more in-depth analysis of the relationship between law and emotion in the field of law. Legal emotion is an important content in the concept of citizen's law. It is also one of the most easily ignored and even denied parts. The legal emotion, like the natural emotion, the moral emotion, the religious emotion and the aesthetic emotion, all belong to the emotional category. What is different is the object that causes various emotions and the social function of various emotions. Compared with other emotional types, legal emotion is the spiritual support of the society ruled by law, and the legal emotion is the citizen's right to the legal system as the main body of the society. The psychological value experience and subjective attitude of all issues related to the law, such as legal phenomena, are not only a matter of individual emotion, but also of great significance to the collective emotion of the whole society. Citizens are either satisfied with the law or excluded or indifferent, In fact, these are all concentrated expressions of legal emotion. In the practice of the rule of law in China, there is a growing trend of negative legal feelings such as dissatisfaction and disdain of the law itself and the judicial outcome, and its social impact is relatively serious. Therefore, it is necessary and urgent to cultivate the positive legal emotion of citizens. The full text is divided into four parts:. The first part combs, analyzes and summarizes the concept of citizen's legal emotion based on the analysis of emotional problem theory, and compares the related concepts related to citizen's legal emotion. The characteristics and importance of citizen's legal emotion are highlighted, and the general content of citizen's legal emotion is pointed out. The second part expounds the factors that affect the formation of citizens' legal emotion from five aspects: history, society, law itself, citizens themselves and the practice of rule of law. Therefore, deeply influenced by the legal culture, at the same time, with the development of the economy and society, the constant change and enrichment of the law, the constant improvement of the law and the improvement of the citizen's quality will directly affect the content and nature of the legal emotion. The result of the practice of rule of law directly reflects the state of the citizen's legal emotion, and each factor affects and advances each other, and influences the formation of the legal emotion together. The third part emphasizes that the ultimate purpose of the important meaning of legal emotion in law is to accelerate the modernization of citizen's legal concept by cultivating the citizen's legal emotion while developing and perfecting the modern legal system. In order to promote the modernization of China's legal system, this paper puts forward several ways to cultivate the citizens' legal emotion in view of the influence factors of the former part. In the 4th part, the legal emotion of citizens has different contents and emphases in different countries, different times and different stages of social development. It needs a kind of general trust emotion of rule of law as its social foundation, which is the spiritual meaning that China's actual situation really needs. Therefore, in the end of the article, it expounds the importance of universal trust to the rule of law in China.
