矿业权有偿出让制度研究

【摘要】: 矿产资源是人类社会赖以生存和发展的不可或缺的物质基础,是国民经济可持续发展的重要保障。矿产资源属于国家所有,由国务院行使国家对矿产资源的所有权。地表或者地下的矿产资源的国家所有权,不因其所依附的土地的所有权或者使用权的不同而改变。矿业权是矿产资源国家所有权派生出来的权利,《中华人民共和国物权法》将其归属于用益物权,从而奠定了全面推行矿业权有偿出让制度的理论基础。矿业权出让方式包括申请审批、招标、拍卖、挂牌、协议和转让方式。矿业权取得制度经历了从无偿到有偿、从非竞争方式到市场竞争方式、从禁止流转到允许流转的诸多变革。根据社会主义市场经济发展理论,结合当前一个时期的经济形势,矿业权出让方式应严格限制行政审批,以招标拍卖挂牌出让方式为主,协议出让方式为辅。近年来,国务院和国土资源部等相关部门出台了一系列规定措施,为进一步深化矿产资源有偿使用及完善矿业权有偿取得制度和建立健全市场配置资源的新机制作出了有益的尝试。但是,当前矿业权出让制度存在的有偿与无偿双轨制并存和税费改革等问题依然不容忽视。针对这些问题,应当以《中华人民共和国矿产资源法》的修订为契机,借鉴国外矿业大国的先进管理经验,将矿业权是用益物权的精神融会到矿产资源法律中去,对过去无偿取得的矿业权进行清理并有偿化;适当提高矿业权使用费和矿产资源补偿费费率标准,建立动态调整机制;改进并加强矿业权评估管理工作;取消资源税;进一步完善矿业权出让制度。
[Abstract]:Mineral resources are the indispensable material basis for the survival and development of human society and an important guarantee for the sustainable development of national economy.Mineral resources are owned by the state, and the State Council exercises state ownership of mineral resources.State ownership of mineral resources on the surface or underground shall not be changed by the ownership or right of use of the land to which it depends.Mining right is the right derived from the state ownership of mineral resources. The property Law of the people's Republic of China assigns it to usufruct right, thus laying a theoretical foundation for the comprehensive implementation of the system of paid transfer of mining rights.Mining right transfer includes application for approval, bidding, auction, listing, agreement and transfer.Mining right acquisition system has experienced many changes from free to paid, from non-competitive mode to market competition mode, from forbidden circulation to allowable circulation.According to the theory of the development of socialist market economy and the economic situation of the present period, the mode of mining right transfer should be strictly restricted by administrative examination and approval, mainly by means of bidding and auction listing, and supplemented by the mode of agreement transfer.In recent years, the State Council, the Ministry of Land and Resources and other relevant departments have issued a series of regulatory measures.In order to further deepen the paid use of mineral resources, improve the system of obtaining mining rights for compensation, and establish a new mechanism of market allocation of resources, a useful attempt has been made.However, the problems existing in the current mining right transfer system, such as the coexistence of paid and unpaid dual track system and tax and fee reform, can not be ignored.In view of these problems, we should take the revision of the Mineral Resources Law of the people's Republic of China as a turning point, learn from the advanced management experience of foreign mining countries, and merge the spirit of mining right as usufruct right into the mineral resources law.Clean up and pay for mining rights acquired without compensation in the past; appropriately raise the standards of mining rights usage fees and mineral resources compensation fees, establish a dynamic adjustment mechanism; improve and strengthen the management of mining rights evaluation; cancel the resource tax;We will further improve the system for the transfer of mining rights.
