【摘要】： 死刑是最严厉的刑罚,其具有悠久的历史,而唐代是中国封建社会法制建设的辉煌时期。本文将死刑置于唐代这一具体的历史时期,试图通过对唐代死刑适用的探讨,来进一步了解唐代死刑适用中的心理、习惯、倾向等,以全面地认识唐代的死刑,及唐代的法律文化,从而使人们对唐律的认识不仅仅停留在律文上,同时还能认识到唐代法律与社会现实生活的内在联系。另一方面,通过对具体的历史条件下死刑适用的研究来加深对死刑本身的认识。本文共包括三个部分,分别是唐代死刑适用状况、影响唐代死刑适用的观念、唐代死刑适用的程序规则。?
[Abstract]:The death penalty is the harshest penalty, which has a long history, and the Tang Dynasty is a glorious period in the construction of the Chinese feudal society. This article puts the death penalty in this specific historical period of the Tang Dynasty, trying to further understand the psychology, habits and tendencies of the death penalty in the Tang Dynasty by discussing the application of the death penalty in the Tang Dynasty, so as to fully understand the Tang Dynasty. The death penalty, and the legal culture of the Tang Dynasty, thus make people's understanding of the law of the Tang Dynasty not only in the law, but also to recognize the internal relations between the law of the Tang Dynasty and the real life of the society. On the other hand, it deepens the understanding of the death penalty through the research on the application of the death penalty under the specific historical conditions. This article includes three parts. It is not only the application of death penalty in Tang Dynasty, but also the concept of application of death penalty in Tang Dynasty, and the procedure rules of death penalty in Tang Dynasty.
