港澳立法机关产生办法比较研究

【摘要】：港澳立法机关产生办法具有很大的相似性,在历史上或现实中都存在委任制、间接选举、直接选举三种方式。香港立法机关在1995年就废除议员委任制,而澳门立法机关至今还存在委任议员。香港立法机关的间接选举在港英时期就出现自然人票,而澳门立法机关间接选举至今还是法人票。虽然澳门立法机关引入议员直选机制早于香港15年,但澳门立法机关中直选议席不仅自身绝对数量的增长缓慢,相对数量(即其在总议席所占的比例)的增长也缓慢。借鉴香港的经验及教训,澳门的立法机关产生办法的改革应把握以下三点:第一,适度增加直选议员的数量;第二,保持社团选举的特色;第三,长期保留委任议席。
[Abstract]:Hong Kong and Macao legislatures have a lot of similarities. In history or reality, there are three ways: appointment system, indirect election and direct election. The Hong Kong legislature abolished the appointment system in 1995, and the Macao legislature still has appointed members. The indirect election of the legislature in Hong Kong appeared during the period of British Hong Kong, while the indirect election of the legislature in Macao is still the vote of legal person. Although the introduction of direct elections in Macao's legislature predates Hong Kong's 15 years, the number of directly elected seats in Macao's legislature has not only grown slowly in its own absolute numbers, but also in relative numbers (that is, its share of total seats). Drawing on the experience and lessons of Hong Kong, the following three points should be grasped in the reform of the method of selecting the legislature in Macao: first, to appropriately increase the number of directly elected members; second, to maintain the characteristics of association elections; and third, to retain appointed seats for a long time.
