法律绩效的公民满意度评估研究

【摘要】: 我国现已开展的法律绩效评估是一种自上而下由立法机关进行的内部评估。这种评估方式对改善立法质量,提高法律绩效有一定的促进作用,但往往容易出现立法部门满意而公民不满意的尴尬局面。立法不仅是立法机关的事,更是关乎全体公民切身利益的大事,立法不仅要立法部门、政府满意,更需要普通公民的满意,因为公民才是法治主体。近几年,一些地方开展了法律绩效评估活动,但在理论和制度空白的情况下,公民评估主体地位的缺失、评估指标混乱、评估方法落后、评估结果往往流于形式,在实践中的价值也受到质疑。 本文正是在这一背景下,.对法律绩效的公民满意度评估作了比较系统的研究。从公民满意度评估基本理论着手,根据发达国家法律绩效的公民满意度评估的制度经验和我国法律绩效评估实践,探索了法律绩效的公民满意度评估的指标体系和具体的评估方法,最后提出了在我国建立法律绩效的公民满意度评估制度的构想。既有理论分析,也有具体实践操作和制度构建,为法律绩效的公民满意度评估提供了较为全面和完整的技术支持和可靠的质量保障。 另外,本文提出了法律绩效评估必须以公民为中心,以公民需求为导向,才能为公民提供合法科学优质的法律法规,确立以公民为本位的法律绩效评估制度,把公民满意度作为法律绩效评估的核心指标和终极标准。同时明确了公民不仅是法律绩效评估的主体,也是提高立法质量,推动法治建设的主导力量。更重要的是,公民可以参与到立法机关对绩效目标的制定和绩效创造中,体现了“以人为本”和“公民参与”的理念,对提升立法的科学性、民主性和合法性具有重大意义。 我国法律绩效的公民满意度评估无论在理论中还是制度实践中都属于新生事物。所以对其进行理论探讨和制度建构则显得尤为必要和及时,这对于提升立法质量,提高法律绩效乃至法治国家的形成,建立回应性、责任化、服务型的公民满意的民主法治政府以及构建和谐社会均具有极其重要的理论和实践意义。
[Abstract]:The legal performance evaluation in China is a kind of internal evaluation from top to bottom by the legislature. This evaluation method has a certain effect on improving the quality of legislation and improving the legal performance, but it is often easy to appear in the embarrassing situation of the legislative department and the dissatisfaction of the citizens. For all the vital interests of the citizens, the legislation not only requires the legislative department, the government is satisfied, but also needs the satisfaction of the ordinary citizens, because the citizen is the subject of the rule of law. In recent years, some places have carried out the legal performance evaluation activities, but in the absence of the theory and system, the status of the citizen evaluation is missing, the evaluation index is confused and the evaluation method is used. Lagging behind, assessment results tend to be formalistic, and their value in practice is also questioned.
Under this background, this paper makes a systematic research on the evaluation of citizen satisfaction of legal performance. From the basic theory of citizen satisfaction assessment, the system experience of citizen satisfaction evaluation in the developed countries and the practice of China's legal performance evaluation, the index of citizen satisfaction evaluation of legal performance is explored. The system and the specific evaluation methods finally put forward the idea of establishing the citizen satisfaction evaluation system of legal performance in our country. It has both theoretical analysis, practical operation and system construction, which provides comprehensive and complete technical support and reliable quality guarantee for the evaluation of citizen satisfaction of legal performance.
In addition, this paper puts forward that legal performance evaluation must be centered on citizens and guided by citizen needs to provide citizens with legal and scientific and quality laws and regulations, to establish a legal performance evaluation system based on citizens, and to take citizen satisfaction as a core index and ultimate standard for the evaluation of legal performance. It is the main body of the legal performance evaluation, and it is also the leading force to improve the quality of legislation and promote the construction of the rule of law. More importantly, citizens can participate in the legislature in the formulation of performance goals and the creation of performance, which embodies the concept of "people-oriented" and "citizen participation", and is important to improve the scientificity, democracy and legitimacy of the legislation. Great significance.
The citizen satisfaction evaluation of the legal performance of our country belongs to the new things both in theory and in the system practice. Therefore, it is particularly necessary and timely to carry out theoretical discussion and system construction, which is to promote the quality of the legislation, improve the legal performance and even the form of the rule of law, and establish a responsive, responsible, and service-oriented citizen. Satisfactory democratic rule of law and harmonious society are of great theoretical and practical significance.
