我国区域立法协调问题研究

【摘要】： 区域立法协调是我国地方立法实践中面临的新课题,本文以立法协调为题,分析我国区域立法协调的必要性,同时在借鉴国外先进经验的基础上,提出了一系列促进区域立法协调的制度化措施。 除了引言和结语外,本文的主体部分分为四章。第一章是对区域立法协调概念争论的梳理和分析,指出区域立法协调与区域共同立法的区别,进而对区域立法协调的概念进行厘定。第二章分别从三个角度论证了我国区域立法协调的必要性,即区域立法协调是我国地方立法横向冲突的协调机制;是我国区域经济一体化的保障机制;是我国跨界管制问题的联动机制。提出在我国特定区域进行地方立法协调是非常必要的,具有重要的理论和现实意义。第三章介绍美国法治协调工具“州际协定”的先进经验,为我国区域立法协调提供资鉴。第四章对区域立法协调的提供了一系列原则、模式和具体运行机制,为其设计了一条可行之路。 本文的深层意义在于为处理地方立法横向冲突问题、推动区域经济一体化进程以及解决跨界问题提供一个思路,即在坚持法治原则和平等的基础上,充分调动区域立法主体的积极性和主动性,进行立法上的协调,整合立法资源,达到区域立法共赢的目的。
[Abstract]:The coordination of regional legislation is a new subject in the practice of local legislation in China. This paper analyzes the necessity of the coordination of regional legislation in our country with the topic of legislative coordination, and at the same time, on the basis of drawing lessons from the advanced experience of foreign countries, A series of measures to promote the coordination of regional legislation are put forward. In addition to the introduction and conclusion, the main part of this paper is divided into four chapters. The first chapter is to sort out and analyze the concept of regional legislative coordination, pointing out the difference between regional legislative coordination and regional common legislation, and then defining the concept of regional legislative coordination. The second chapter demonstrates the necessity of regional legislation coordination from three angles, namely, regional legislation coordination is the coordination mechanism of horizontal conflict of local legislation in China, it is the safeguard mechanism of regional economic integration in China. It is the linkage mechanism of cross-border control in our country. It is very necessary to coordinate local legislation in specific regions of our country, which has important theoretical and practical significance. The third chapter introduces the advanced experience of the interstate agreement, which is the coordination tool of American rule of law, and provides a reference for the harmonization of regional legislation in our country. The fourth chapter provides a series of principles, models and specific operating mechanisms for the coordination of regional legislation, and designs a feasible way for it. The deep meaning of this paper is to provide a way to deal with the horizontal conflict of local legislation, to promote the process of regional economic integration and to solve the cross-border problems, that is, on the basis of upholding the principle of rule of law and equality. Fully mobilize the enthusiasm and initiative of the main body of regional legislation, coordinate the legislation, integrate the legislative resources, and achieve the goal of win-win regional legislation.
