全国人大常委会立法政策反思——以立法修改背景下的司法解释为例的分析

【摘要】:司法解释的存在应以必要为原则,全国人大常委会作为立法者应充分利用主客观条件尽可能使法律完善,不应人为制造司法解释存在的制度空间。立法在修改时,应充分吸收既有司法解释和司法实践经验,有效回应司法的现实需求。近年来,多部法律修改后既有司法解释继续施行、法律修改后最高人民法院根据立法前经验制定新司法解释等现象的存在表明,全国人大常委会在立法中,在一定程度上仍然未能充分而有效地吸收既有司法解释和司法实践经验。在法律体系初步建成的条件下,全国人大常委会在立法中,应严格限制"法律不宜太细"政策的适用,全面转向以司法为中心,立法在制定和在修改时,应当充分吸收既有司法解释和司法实践经验,更为有效地回应司法实践中急需解决的各种问题。
[Abstract]:The existence of judicial interpretation should be based on the principle of necessity. As a legislator, the standing Committee of the National people's Congress should make full use of subjective and objective conditions to perfect the law as far as possible, and should not create a system space for judicial interpretation. When the legislation is amended, it should fully absorb the experience of judicial interpretation and judicial practice, and respond effectively to the actual needs of judicature. In recent years, after many laws have been amended, existing judicial interpretations have continued to be implemented. The existence of new judicial interpretations formulated by the Supreme people's Court on the basis of its pre-legislative experience shows that the standing Committee of the National people's Congress is in the process of legislating. To a certain extent, it still fails to fully and effectively absorb the existing judicial interpretation and judicial practice experience. Under the condition that the legal system is initially established, the NPC standing Committee should strictly restrict the application of the policy of "the law should not be too detailed" in its legislation, and turn to the judicial center in an all-round way, and when the legislation is formulated and amended, We should fully absorb the experience of judicial interpretation and judicial practice, and respond more effectively to all kinds of problems that need to be solved in judicial practice.
