民事诉讼检察监督论

【摘要】：民事诉讼检察监督制度是检察制度的重要内容,同时也是民事诉讼法律制度的重要组成部分。我国自1991年《民事诉讼法》颁布以来,民事诉讼检察监督制度得到了长足发展。经过2007年修改,《民事诉讼法》对检察监督的若干问题进行了细化,但仍在理论和实践中留下很多争议和空白。司法实践证明,人民检察院行使民事诉讼检察监督权是完善民事诉讼必不可少的保障机制,是有效的司法救济方法。但是,目前法律规定的民事诉讼检察监督机制存在着规定过于原则、监督范围狭窄、缺乏操作性等一系列问题,一定程度上使检察机关行使这项权力流于形式,难以发挥应有的作用。构建一套完整的民事诉讼检察监督体系,并使之有效地运行和实施,这对于保障司法活动的公正性、维护国家和社会公共利益无疑具有重大的现实意义。 2012年8月31日《民事诉讼法》再次修订,加强民事诉讼检察监督是此次民诉法修改的重要内容,也是各方期待。本文立足于我国的具体国情,结合民事诉讼检察监督实践,分别从民事诉讼检察监督基本原则的概念和功能、民事诉讼检察监督制度的设立基础与价值取向、我国民事诉讼检察监督制度的“存废之争”、我国民事诉讼检察监督制度的基本原则设计四个方面进行理论上的探讨,并就民事诉讼检察监督实务中比较热点的几个具体问题进行理论结合实践的剖析,以期进一步完善民事诉讼检察监督理论和强化民事诉讼检察监督体制,推动民事诉讼检察工作的健康发展,发挥民事诉讼检察监督权应有的作用。
[Abstract]:The system of procuratorial supervision in civil proceedings is an important part of the procuratorial system and also an important part of the legal system of civil litigation. Since 1991, the Civil procedure Law has been promulgated in China. The system of procuratorial supervision in civil proceedings has been greatly developed. After the amendment in 2007, the Civil procedure Law has refined some problems of procuratorial supervision, but it still leaves a lot of disputes and gaps in theory and practice. The people's Procuratorate's exercise of the procuratorial supervision power in civil proceedings is an indispensable safeguard mechanism for perfecting civil litigation and an effective judicial remedy method. However, there are too many principles in the procuratorial supervision mechanism of civil litigation stipulated by the law at present. A series of problems, such as narrow scope of supervision and lack of maneuverability, to some extent make the exercise of this power by procuratorial organs become mere formality, and it is difficult to play its due role. It is undoubtedly of great practical significance to ensure the justice of judicial activities and safeguard the public interests of the state and society. In August 31st 2012, the Civil procedure Law was revised again, strengthening the procuratorial supervision of civil litigation is the important content of the revision of the Civil procedure Law, and is also the expectation of all parties. This paper bases itself on the specific conditions of our country and combines the practice of procuratorial supervision in civil litigation. From the concept and function of the basic principles of procuratorial supervision in civil litigation, the foundation and value orientation of the system of procuratorial supervision in civil litigation, This paper discusses four aspects of the basic principles of the procuratorial supervision system of civil litigation in our country, namely, "the dispute between existence and abolition", and the design of the basic principles of the system of procuratorial supervision in China's civil litigation. In order to further improve the theory of procuratorial supervision in civil litigation and strengthen the system of procuratorial supervision in civil litigation, the author analyzes several specific problems in the practice of procuratorial supervision in civil litigation, which are relatively hot in practice, in order to further improve the theory of procuratorial supervision in civil litigation. To promote the healthy development of the procuratorial work in civil litigation and give play to the due role of the procuratorial supervision power in civil litigation.
