【摘要】：法官作出裁判的过程不仅仅是一种纯粹的逻辑过程,而是会常常受到其他因素的影响,法官的个性正是其中之一。人的个性会影响人的行为方式,法官亦然。本文从作为人的法官这个视角入手,分析法官个性与司法公正之间的关系,研究法官个性影响司法公正的必然性,并探讨如何发挥这种影响的积极作用,抑制其消极作用。第一章主要就与本文相关的一系列概念,如个性、法官个性、司法公正等,进行了界定。其中着重介绍了法官个性的构成因素,即个人的性别、经验、价值观、道德观、综合能力以及一些非理性因素等。第二章通过阐述在司法环境中的法官及其角色定位,法官裁判活动的制约因素,对法官的裁判活动进行了分析。并进一步分析由于成文法存在着难以避免的局限性,认定案件事实的不确定性,以及哲学、社会学等层面上的原因,法官个性对司法公正必然会产生影响。最后,从法官个性的各个构成因素来分析法官个性是怎样对司法公正产生影响的。第三章分析了非理性因素中的积极因素、法官的人生经验、良好的职业素养、正确的道德观、价值观等都会对司法公正产生积极影响;相对应的,另一方面,这种影响可能是消极的,例如法官个性中的性别、非理性因素中的消极因素、错误的价值观以及道德观等都会对法官裁判,进而对司法公正产生消极影响。为了更好的发挥法官个性对司法公正的积极影响,抑制其消极影响,本文从两个方面来探讨。一是通过加强法官的职业道德教育、固化法官良知以及形成法律信仰等方面完善法官自身素质;二是通过强化合议制的切实实施、完善法官选拔制度以及完善法官保障制度等三个方面进行制度建设的完善。
[Abstract]:The judge's decision process is not only a purely logical process, but also often influenced by other factors. The judge's personality is one of them. This paper analyzes the relationship between the personality of the judge and judicial justice, studies the inevitability of the influence of the personality of the judge on the judicial justice, and discusses how to play the positive role of the influence. Inhibit its negative effects. The first chapter defines a series of concepts related to this article, such as personality, judge personality, judicial justice and so on. The second chapter elaborates the judges and their roles in the judicial environment, the constraints of judges' adjudication activities, and so on. This paper analyzes the judges' adjudication activities, and further analyzes the reasons for the uncertainty of the facts of the case, philosophy, sociology, and so on, due to the unavoidable limitations of statutory law. The personality of the judge will inevitably influence the judicial justice. Finally, the author analyzes the influence of the personality of the judge on the judicial justice from the aspects of the individual character of the judge. The third chapter analyzes the positive factors in the irrational factors, the life experience of judges, good professional accomplishment, correct morality, values and so on will have a positive impact on judicial justice; on the other hand, The influence may be negative, such as gender in the judge's personality, negative factors in irrational factors, wrong values and moral values, etc. In order to give full play to the positive influence of judge's personality on judicial justice and restrain its negative influence, this paper probes into it from two aspects. One is to strengthen the professional ethics education of judges. Solidify the conscience of judges and form legal beliefs to improve the quality of judges; second, through strengthening the implementation of the collegial system, improving the selection system of judges and improving the system of protection of judges to improve the system.
