分段集约执行机制的实证分析与反思重构

【摘要】:本文从分段集约执行机制基础的分权制衡理论与分工增益理论出发,通过实证分析指出现行分段集约执行模式并未达到程序设计之初提高执行工作质量与效率的客观事实,并反思得出其根本原因在于现行模式在程序设计上与执行实施固有规律不符的结论。基于此,笔者以分权制衡理论与分工增益理论在执行实施中的重新细化考量为视角,得出最有效的分权制衡仅要求将执行处置权予以分离,最有效的分工仅要求将现行模式下依据不同执行阶段的"横向"分工转变为低交换成本的"纵向"分工方式的结论。最后笔者结合当前司法改革的方向,在分别参考国内现有改革经验与域外执行人员分工的基础上,提出单设执行处置部门行使执行处置权,将以往执行庭内部的分段转变为执行局部门间的分权,将执行实施工作分为判断性工作与事务性工作分别由执行法官与执行辅助人员承担的重构方法,以期通过对执行实施权的合理配置与执行人员的合理分工为法院解决执行难问题提供一种内在的解决思路。
[Abstract]:Based on the theory of separation of powers and gains of division of labor on the basis of piecewise intensive execution mechanism, this paper points out through empirical analysis that the current mode of piecewise intensive execution has not reached the objective fact of improving the quality and efficiency of execution at the beginning of program design. It is concluded that the basic reason lies in the fact that the current mode is not consistent with the inherent law of execution. Based on this, the author takes the theory of separation of powers and the theory of division of labor gain as the angle of view of rethinking in the implementation of the implementation of the separation of powers and checks and balances and the theory of division of labor. Came to the conclusion that the most effective decentralized checks and balances only require the separation of executive powers of disposal, The most effective division of labor only requires the conclusion that the "horizontal" division of labor under the current mode should be transformed into a "vertical" division of labor with low exchange cost according to the different stages of implementation. Finally, the author combines the direction of the current judicial reform. On the basis of reference to the existing domestic reform experience and the division of labour among the overseas practitioners, it is proposed that a separate execution and disposal department be established to exercise the enforcement and disposal authority, and to transform the previous segment within the executive chamber into a division of powers among the executive boards. The reconstruction method that divides the execution work into the judgment work and the transactional work by the executive judge and the executive assistant staff respectively, It is expected that the rational allocation of enforcement power and the rational division of enforcement personnel will provide an internal solution for the court to solve the problem of enforcement difficulties.
