独立民事诉讼检察监督的法理基础及其制度构建研究

【摘要】：民事诉讼检察监督制度存在的目的是通过检察权对审判权的督促，维护司法的公正和效率，以实现司法程序的合理运行并维护法律的权威。民事诉讼检察监督以抗诉再审为主体，由于抗诉再审程序设计在实际运行中存在很多问题和不足，检察院的民事抗诉权仅仅是再审程序启动权，缺乏独立的审理程序，检察监督程序的非独立性及现有监督制度本身的缺陷削弱了检察监督的实效性。为此，加强民事诉讼检察监督问题的理论研究，构建独立的民事诉讼检察监督制度具有迫切的现实意义。本文从这个角度出发，通过对现行民事诉讼检察监督制度的分析，找出现有制度的缺陷及造成这些问题的原因，对比中西方检察监督制度的差异性以及我国自身的特点，对独立民事诉讼检察监督程序的设立问题进行了初步探讨，内容结构主要分为以下几个部分：第一部分，论述了本文的选题背景，研究意义，研究方法及思路。第二部分，以我国民事诉讼法的规定为出发点，结合司法实践中出现的问题和争议，总结民事诉讼检察监督制度存在的弊端，，并分析出现问题的原因。第三部分，从法理层面分析，构建我国独立民事诉讼检察监督程序的理论。通过对比中西方检察监督制度发展的不同点讨论权力监督与权力制约的差别，论证了我国检察权的本质和存在的问题，并寻求建立独立民事诉讼检察监督程序的目的和必要性。第四部分，以前三部分论述为基础，提出构建独立民事诉讼检察监督程序的具体设想，同时表明制度的构建是一个复杂和漫长的过程，需要长期不断的检验和实践，在实践反馈基础上的不断改进，方能最终达到完善。
[Abstract]:The purpose of the existence of the procuratorial supervision system in civil litigation is to maintain the justice and efficiency of the judiciary through the supervision of the judicial power by the procuratorial power. In order to realize the reasonable operation of the judicial procedure and maintain the authority of the law, the procuratorial supervision of civil action takes the protest retrial as the main body, because there are many problems and deficiencies in the actual operation of the design of the protest retrial procedure. The procuratorate's right of civil protest is only the right to start the retrial procedure, and the lack of independent trial procedure, the non-independence of the procuratorial supervision procedure and the defects of the existing supervisory system weaken the effectiveness of the procuratorial supervision. It is of urgent practical significance to strengthen the theoretical research on the procuratorial supervision in civil litigation and to construct an independent procuratorial supervision system in civil litigation. From this angle, this paper analyzes the current procuratorial supervision system in civil litigation. To find out the defects of the system and the causes of these problems, comparing the differences of the procuratorial supervision system between China and the West and the characteristics of our own, this paper makes a preliminary discussion on the establishment of the procuratorial supervision procedure in independent civil litigation. The content structure is divided into the following parts:. The first part discusses the background, research significance, research methods and ideas of this paper. The second part, with the provisions of our civil procedure law as the starting point, combined with the judicial practice of the problems and disputes, This paper summarizes the drawbacks of the procuratorial supervision system in civil litigation, and analyzes the causes of the problems. By comparing the differences between the development of procuratorial supervision system between China and the West, the paper discusses the differences between power supervision and power restriction, and demonstrates the essence and existing problems of procuratorial power in China. The purpose and necessity of establishing the independent civil procedure of procuratorial supervision are also sought. Part 4th, on the basis of the previous three parts, puts forward the concrete idea of constructing the independent civil procedure of procuratorial supervision. At the same time, it shows that the construction of the system is a complex and long process, which requires long-term continuous testing and practice, and continuous improvement on the basis of practice feedback, in order to achieve the final perfection.
