改革背景下的中国铁路检察制度探析

【摘要】：铁路检察制度是中国特色检察制度的重要组成部分。新中国成立后，国家为了适应新时期国民政治、经济发展的需要，维护国家铁路大动脉的安全畅通而在铁路系统内部建立起了一套特殊的检察制度。经历了几十年的发展，铁路检察制度逐步走向成熟和完善。随着我国经济的迅猛发展，铁路检察机关保障铁路行业安全稳定的作用愈发突出，为强化法律监督、捍卫铁路运输安全做出了重大的贡献。在肯定铁路检察工作的同时，对于现有铁路检察制度在内部管理、外部监督和案件管辖方面所存在的争议也一直不绝于耳。多年来，国家一直都在为铁路检察体制的改革而努力。几经探索，在2009年中央正式开始着手全国铁路检察制度改革工作。由于我国铁路检察体制的历史较短，国外又缺乏更多的借鉴模式，加上改革中各方之间的利益之间的博弈，，导致本次改革并没有彻底解决铁路检察体制的固有顽疾，铁路检察体制的改革依旧任重道远。笔者通过研究现有理论成果，并结合自己在铁路检察机关工作的实际经验，为铁路检察机关的未来走向构想出了两套改革方案：一是按照专门检察制度的模式，将现有铁路检察制度分为四级模式进行改革；二是参考俄罗斯经验，构建一个包含铁路、公路、民航、水运在内的大交通检察制度。目前国内对于铁路检察制度的研究相对较少，希望通过本文的论述，能够引起人们对于这一问题的更多思考，为实现我国铁路检察事业的健康发展而做出积极地努力。
[Abstract]:The railway procuratorial system is an important part of the procuratorial system with Chinese characteristics.After the founding of New China, the state established a special procuratorial system within the railway system in order to meet the needs of the national politics and economic development in the new period and to maintain the safety and unimpeded state railway artery.After decades of development, the railway procuratorial system is gradually mature and perfect.With the rapid development of China's economy, the role of railway procuratorial organs in ensuring the safety and stability of the railway industry has become increasingly prominent, which has made great contributions to strengthening legal supervision and safeguarding the safety of railway transportation.While affirming the railway procuratorial work, the existing railway procuratorial system in the internal management, external supervision and case jurisdiction has always been controversial.For many years, the country has been working hard for the reform of the railway procuratorial system.After several explorations, in 2009 the Central Committee officially began to reform the national railway procuratorial system.Due to the short history of the railway procuratorial system in our country, the lack of more foreign models for reference, and the game between the interests of all parties in the reform, this reform has not completely solved the inherent problems of the railway procuratorial system.The reform of the railway procuratorial system still has a long way to go.By studying the existing theoretical achievements and combining with my own practical experience in the work of railway procuratorial organs, the author proposes two reform plans for the future direction of railway procuratorial organs: first, according to the mode of special procuratorial system,The existing railway procuratorial system is divided into four modes to carry on the reform; the second is to refer to the Russian experience to construct a large transportation procuratorial system including railway highway civil aviation and water transportation.At present, there are few researches on railway procuratorial system in China. It is hoped that through the discussion of this paper, people can think more about this issue and make active efforts to realize the healthy development of railway procuratorial cause in China.
