法国社区矫正制度介评及其对中国的借鉴与启示

【摘要】：在中国的社区矫正实践中,社区矫正制度优势没能很好地体现出来,其主要原因在于社区矫正立法等法制建设方面及社会各方面力量参与社区矫正程度有待提升。通过对法国社区矫正制度考察与介评,发现一方面其社区矫正法律较完备,各工作主体明确,部门之间配合有序,社区服刑人员义务和监督措施明确,非监禁刑广泛适用,非监禁刑形式多样,体现刑罚个人化原则;另一方面政府注重投入和引导各类协会参与社区矫正,为社会力量参与搭建了较好平台。结合中国实际,在借鉴与总结法国经验的基础上,社区矫正制度应从以下几个方面发展和完善:一是加快立法进程、完善社区矫正法制体系;二是进行刑罚执行体制改革,扩大社区矫正适用对象;三是建立一体化刑罚执行体系,强化队伍专业化、职业化建设;四是政府积极引导和投入,整合各方社会资源参与社区矫正。
[Abstract]:In the practice of community correction in China, the advantages of community correction system are not well reflected, the main reason is that the community correction legislation and other legal construction and social forces involved in community correction need to be improved.Through the investigation and review of the community correction system in France, it is found that, on the one hand, the law of community correction is relatively complete, the working subjects are clear, the departments cooperate with each other in an orderly manner, the obligations and supervision measures of community prisoners are clear, and the non-imprisonment penalty is widely applied.On the other hand, the government pays attention to investing and guiding various associations to participate in community correction, which provides a better platform for social forces to participate.On the basis of drawing lessons from and summing up the experience of France, the community correction system should be developed and perfected in the following aspects: first, speeding up the legislative process and perfecting the legal system of community correction; second, carrying out the reform of the penalty enforcement system.The third is to establish an integrated penalty execution system, to strengthen the professionalization of the team, and the fourth is to actively guide and invest the government to integrate social resources to participate in community correction.
