中国法官职业化管理探析

【摘要】:中国在历史上,法官和行政官员一直没有区分,近代的法院是大致按照三权分立的理念人为地从“衙门”中分离出来的,因此很容易被视为另一个解决纠纷的行政机构,而不是司法审判机构,因此行政化管理模式是中国法院管理的传统模式。行政化管理模式把法院当作行政机关,把法官当作一般行政管理对象,从而造成了行政权凌驾于审判权之上的权力错位现象。本文运用比较分析的研究方法,通过对中国现行法官管理制度现状的分析,针对中国法官管理制度存在的种种缺陷,借鉴西方发达国家法官职业化管理的成型经验,结合理论界和实务界的理论研究成果,论证了在中国推行法官职业化管理的必要性和可行性,并据此提出了从制度机制入手,强化法官职业化管理改革的一些建议。
[Abstract]:In the history of China, there has been no distinction between judges and administrative officials. The modern courts were artificially separated from the "Yamen" in accordance with the concept of separation of powers, so it is easy to be regarded as another administrative body for resolving disputes. Therefore, the administrative management mode is the traditional mode of Chinese court management. The administrative management mode regards the court as the administrative organ and the judge as the general administrative object, which results in the power dislocation of the administrative power over the judicial power. Through the analysis of the present situation of the judge management system in China, this paper uses the comparative analysis method, aiming at the defects of the judge management system in China, and drawing lessons from the formative experience of the professional management of the judges in the western developed countries. Combined with the theoretical research results of the theoretical and practical circles, this paper demonstrates the necessity and feasibility of implementing the professionalized management of judges in China, and puts forward some suggestions on strengthening the reform of the professionalized management of judges from the perspective of the system mechanism.
