论我国刑罚执行中罪犯人权的检察保障

【摘要】：人权是作为西方资产阶级文化的产物而登上历史舞台的。整个西方资产阶级人权理论经历了几百年的演变,已经形成了一套完整而成熟的体系。近年来,人权保障问题已经成为以美国为代表的发达国家攻击中国、遏制中国发展的重要战略和手段之一。我国人权理论的提出和快速发展,既是同西方国家进行人权政治斗争的需要,又是我国政府对这一领域关注和重视的必然结果。罪犯作为特殊的公民群体,其人权当然受到《中华人民共和国宪法》关于“国家尊重和保障人权”规定的保护。但是由于历史和现实因素,罪犯人权保护问题还没有得到足够的重视,司法实践中还存在着不少罪犯人权得不到充分保障的现象。检察机关作为法律监督机关,负有监督刑罚执行、保障罪犯人权的法定职责。罪犯人权离不开检察机关的监督和保障。因此,构建刑罚执行中的罪犯人权检察保障体系显得尤为重要。本文以大量调研数据为基础,从司法实践出发,通过分析我国罪犯人权的现状,找到罪犯人权保障存在的不足之处,并从检察机关的角度阐述了如何充分发挥检察制度的监督职能,突出检察机关在构建刑罚执行中罪犯人权保障体系中的主导作用,并力图通过这种主导作用,带动其他相关人权保障机制的建设,最终推动我国罪犯人权保障体系的发展和完善。
[Abstract]:Human rights, as a product of Western bourgeois culture, is on the stage of history. The whole western bourgeois theory of human rights has evolved for hundreds of years and has formed a complete and mature system. In recent years, the issue of human rights protection has become one of the important strategies and means for developed countries, represented by the United States, to attack China and curb its development. The rapid development of human rights theory in China is not only the need of human rights political struggle with western countries, but also the inevitable result of our government paying attention to this field. As a special group of citizens, the human rights of criminals are of course protected by the Constitution of the people's Republic of China concerning "the state respects and protects human rights". However, due to historical and practical factors, the protection of criminal human rights has not been paid enough attention to, and there are still many criminal human rights can not be fully protected in judicial practice. The procuratorial organ, as the legal supervision organ, has the legal duty to supervise the execution of penalty and protect the human rights of criminals. Human rights of criminals can not be separated from the supervision and protection of procuratorial organs. Therefore, it is very important to construct the criminal human rights procuratorial system. Based on a large number of investigation data and judicial practice, this paper analyzes the present situation of human rights of criminals in China, and finds out the shortcomings of the protection of human rights of criminals. From the point of view of procuratorial organs, it expounds how to give full play to the supervisory function of procuratorial system, to highlight the leading role of procuratorial organs in the construction of criminal human rights guarantee system in the execution of penalty, and tries hard to pass this leading role. Promote the construction of other relevant human rights protection mechanism, and finally promote the development and improvement of criminal human rights protection system in China.
