政法委及公、检、法相互关系的改革

【摘要】：正笔者讨论的是一个比较广义的司法改革,不仅包括法院的改革,还包含整个司法系统的改革,即包括政法委、公安机关和法院等。关于政法委,主要是使其正确发挥作用。这包括三个方面的内容。第一,要科学配置政法委职权,有所为有所不为。比如政法委是否要领导和干预劳动教养等问题,就值得讨论。政法委书记这个职位与政法委这个机构,两者的权力不能混同。第二,要避免以党代政。比
[Abstract]:The author is discussing a broader judicial reform, including not only the reform of the court, but also the reform of the entire judicial system, that is, the political and legal committee, the public security organs and the court, and so on. With regard to the political and legal Commission, the main purpose is to make it work correctly. This includes three aspects. First, it is necessary to scientifically allocate the functions and powers of the political and legal Commission and do something wrong. For example, whether the political and legal commissions should lead and intervene in reeducation through labor is worth discussing.
