【摘要】：法律职业共同体一直是一个热门话题,不仅是西方研究的重点,我国近年来也开始加大对法律职业共同体的关注。西方现代经济、政治的高度发展离不开法律职业共同体的法治建设,西方有着自己的法律职业发展历程,可以说法律职业共同体是在本土的法治资源中逐渐发展壮大。我国的法律职业共同体是在法治现代化的进程中移植引进的结果,法律职业共同体不能通过自然生成,只能依靠建构的形式加以进行。当今社会的高效运转,社会结构的日益复杂离不开法律职业共同体,一个健康稳定的法律职业共同体是时代的选择,是法治发展的必然要求。当今我国法律职业共同体虽然取得一定成果,但实际运行中依然存在着制约因素,建构一个良好的法律职业共同体势在必行。本文除第一章绪论之外,共包含以下四部分内容:第一部分主要论述法律职业共同体的基本问题,分别从概念、特征和价值意义等方面对法律职业共同体的基础知识进行梳理和总结;第二部分主要论述当今法律职业共同体的问题以及原因分析。当今我国法律职业共同体存在着三个方面的问题,即法律职业者间难以认同、法律职业人才储备不足以及法律职业者的安全感有所降低。在阐述问题后,对这些问题进行分析找的答案,本文归纳为缺乏法治精神、职业准入门槛过低、缺乏有效的沟通、法学教育的失衡以及司法行政化;第三部分主要论述西方法律职业共同体的自然生成和发展模式,分别从教育、职业转化、职业伦理等方面进行总结;文章的第四部分主要论述我国法律职业共同体的建构路径探析,从健全共同交流平台、完善法学教育、职业培训、保障制度、职业准入制度和职业伦理等方面进行建构。法律职业共同体的重要性已经达成共识,法治的发展离不开法律职业共同体。法律职业共同体需要良好的环境进行建构,在进行建构的过程中,正确面对出现的问题并加以分析,找出问题的关键所在从而建构符合我国法治发展的法律职业共同体。在研究西方法律职业共同的生成和发展模式的同时,更好的借鉴西方的优秀成果经验,在我国本土的法治资源中加以吸收。法律职业共同体的建构在借鉴西方发展模式的同时,还要具有中国特色。
[Abstract]:The legal profession community has always been a hot topic, not only the focus of western research, but also in recent years, our country has also begun to pay more attention to the legal profession community. The high development of western modern economy and politics is inseparable from the rule of law construction of the legal profession community. The West has its own legal career development process and can be said to be legal profession. The community is developing and expanding gradually in the local rule of law. The legal profession community of our country is the result of transplantation in the process of modernization of the rule of law. The legal profession community can not be generated by natural generation and can only be carried out by the form of construction. The efficient operation of today's society and the increasingly complex social structure can not be separated from the law. The professional community, a healthy and stable legal profession community is the choice of the times, is the inevitable requirement of the development of the rule of law. Although the legal professional community in our country has achieved certain achievements, there are still restrictive factors in the actual operation, and it is necessary to construct a good common form of legal profession. It includes the following four parts: the first part mainly discusses the basic problems of the legal profession community. The basic knowledge of the legal profession community is summarized and summarized from the concept, the characteristics and the value meaning respectively. The second part mainly discusses the problems and reasons of the current legal profession common body and the reason analysis. There are three problems in the industry community, that is, the difficult to identify among the legal profession, the lack of the reserve of legal professionals and the decrease of the sense of security of the legal professionals. After the elaboration of the problems, the answers to these problems are summarized as the lack of the spirit of the rule of law, the low threshold of professional access, the lack of effective communication, and the law of law. The unbalance of education and the administration of judicature; the third part mainly discusses the natural generation and development pattern of the western legal professional community, which are summarized from the aspects of education, career transformation and professional ethics, respectively. The fourth part of the article mainly discusses the construction path of the legal profession community in China, and improves the common communication platform and consummate the common communication platform. Legal education, vocational training, guarantee system, professional access system and professional ethics have been constructed. The importance of the legal profession community has reached a consensus. The development of the rule of law can not be separated from the legal profession community. The legal profession community needs a good environment to construct. In the process of construction, it is correct to face the question of the emergence of the legal profession. The key of the problem is to find out the key of the problem so as to construct the legal profession community which is in line with the development of the rule of law in our country. In the study of the common generation and development pattern of the western legal profession, we can learn from the experience of the western excellent results better and absorb in the local rule of law in our country. The construction of the legal profession community is borrowed. While learning the western development model, we must also have Chinese characteristics.
