司法成本控制下法官精英化的改革出路

【摘要】：司法成本控制与法官的成本投入息息相关。社会发展多元化反向刺激了法官的职业化,最终与司法精英化、专业化的法治潮流背道而驰,因此以司法成本控制为导向的法官精英化改革势在必行。司法成本控制是理想和目的,法官精英化是方式和手段,精英化又以员额制为主要形式。通过阐释法官精英化面临的困境与挑战,探求改革的路径,以期建立一个良好的法治生态。
[Abstract]:The judicial cost control is closely related to the cost input of the judge. The diversification of the social development has stimulated the professionalization of the judge, and finally runs counter to the judicial elites and the professional rule of law. Therefore, the reform of the judge's elitism guided by the judicial cost control is imperative. The cost control of the law is the ideal and purpose, the judge is elitist. It is the way and means, and the main form of the elite is the system of staffing. By explaining the difficulties and challenges faced by the judge's elitism, the path of the reform is explored in order to establish a good rule of law ecology.
