我国执行力扩张制度研究

【摘要】：当前,对我国执行力扩张制度的研究大多仅局限于执行力主观范围的扩张和依赖于借鉴域外立法例的扩张程序构建。不过,这些研究没有涵盖我国执行力扩张的全部内涵。我国的执行力扩张制度,应包括执行力扩张的实体内容和程序内容。其中执行力扩张的实体内容包括执行力主观范围的扩张和客观范围的扩张。主观范围的扩张除了执行力向执行承担人、标的物占有人、诉讼担当之被担当人的扩张外,还应包括基于执行担保的约定扩张、基于社会发展需要的政策性扩张。执行力的客观范围的扩张包括执行标的的扩张和执行措施的扩张。对执行力扩张的程序内容,应当根据扩张中是否发生了诉的标的的变化进行不同的设计。
[Abstract]:At present, most of the research on the implementation force expansion system in China is limited to the expansion of the subjective scope of executive force and the construction of expansion procedures that rely on foreign legislation. However, these studies do not cover all the connotation of the expansion of our country's executive force.
