试论最高人民法院案例指导制度

【摘要】：最高人民法院公布典型案例的做法久已有之，多年来地方各级人民法院对案例指导工作也进行了大量的探索和实践。基于司法的需要并沿袭实践的惯性，2005年，《人民法院第二个五年纲要》中正式提出建立和完善案例指导制度。2010年11月26日，最高人民法院发布（法发【2010】51号）《关于案例指导工作的规定》（下称《规定》）。《规定》的出台标志着最高法院“案例指导制度”正式登上了我国法治舞台。《规定》的内容解决了案例指导制度在发展过程中出现的一些问题，但主要集中在指导性案例产生的程序问题方面。对于案例指导制度的效力及适用问题着墨较少。而这正是本文的出发点。本文试图在分析《规定》的基础上，就《规定》中存在的缺陷从操作和技术层面作初步探索。本文的主要内容由以下几部分构成。引言部分概述了案例在我国历史各阶段法律制度中的发展和作用，并指出案例指导制度在我国的存在与发展已是客观现实。第一章对最高法院案例指导制度作出概括性界定，，并针对《规定》的内容进行分析，指出该制度的发展现状。第二章从《规定》中未明确的关键词“应当”着手，分析案例指导制度的效力问题，得出我国最高法院案例指导制度具有“事实上的拘束力”。第三章对案例指导制度的具体适用提出了初步的看法。本文认为指导性案例的适用需要具备一定的条件，并应明确启动主体、可参照部分和适用的具体方法。结论部分进一步总结了本文的主要观点，并在此基础上，展望了最高法院案例指导制度作为一项新的制度其发展前景。
[Abstract]:The Supreme people's Court has published typical cases for a long time, and the local people's courts at all levels have carried out a great deal of exploration and practice on the case guidance work for many years. Based on the needs of justice and the inertia of practice, in 2005, the second Five-Year outline of the people's Court formally proposed to establish and perfect the case guidance system. The Supreme people's Court issued (Fa Fa [2010] 51) the provisions on case guidance (hereinafter referred to as "regulations"). The introduction of the "case guidance system" of the Supreme people's Court marks that the Supreme Court "case guidance system" has formally entered the stage of rule by law in China. The content addresses some of the problems that arise in the development of the case guidance system, However, it mainly focuses on the procedural issues arising from the guiding cases. The effectiveness and application of the case guidance system is less. This is the starting point of this paper. Based on the analysis of "stipulation", this paper attempts to make a preliminary exploration on the defects in the "stipulation" from the operational and technical aspects. The main content of this paper consists of the following parts. The introduction summarizes the development and function of cases in different stages of our country's history, and points out that the existence and development of case guidance system in China is an objective reality. The first chapter gives a general definition of the case guidance system of the Supreme Court, analyzes the contents of the provisions, and points out the development status of the system. The second chapter analyzes the effectiveness of the case guidance system and concludes that the case guidance system of the Supreme Court of China has a "de facto binding force" from the undefined keyword "shall" in the "stipulation". The third chapter puts forward the preliminary views on the application of the case guidance system. This paper holds that the application of instructive cases should have certain conditions, and should clearly start the main body, can refer to the part and the specific method of application. The conclusion further summarizes the main points of this paper and, on this basis, looks forward to the development prospects of the Supreme Court case guidance system as a new system.
