恢复性司法理念下社区矫正效果评价体系研究

【摘要】：恢复性司法的核心内容就是动员全社会力量,吸收被害人和犯罪嫌疑人所在的社区参与到对犯罪的惩治程序中来,其主要特征在于恢复性。在恢复性司法理念下,社区矫正效果的评价体系首先需体现被害人的意愿,以使其真正走出犯罪伤害的阴影,恢复被损害的精神创伤;其次需认真对待社区居民对矫正对象改造效果的评价,重视他们对矫正对象改造的满意程度,恢复被损害的人际关系;再者需将矫正对象所在单位及亲友对其的评价列入评价体系,以使评价结论更客观、公正,恢复被损害的社会秩序。
[Abstract]:The core content of restorative justice is to mobilize the whole society and absorb the victims and criminal suspects in the community to participate in the process of punishing the crime, the main feature of which is restorative. Under the concept of restorative justice, the evaluation system of community correction effect should first reflect the will of the victims, so that they can really get out of the shadow of criminal injury and recover the injured mental trauma. Secondly, it is necessary to seriously treat the community residents' evaluation of the effect of the correction object transformation, attach importance to their satisfaction with the correction object transformation, and restore the damaged interpersonal relationship. Furthermore, it is necessary to include in the evaluation system the evaluation of the objects of correction and their relatives and friends in order to make the evaluation conclusions more objective, just and restore the damaged social order.
