论我国律师协会的自治

【摘要】：当律师发展成为一种职业群体,律师行业的管理模式就需要与时俱进的加以改革,需要不断完善。我国目前对律师行业的管理模式主要就是司法行政部门的行政管理和律师协会的行业管理相结合的管理模式,简称“两结合”的管理模式。随着市场经济的发展,法制社会建设进程的需求,从事律师职业的法律工作者日益增多,这种“两结合”的管理模式已经满足不了庞大的律师职业队伍的需求,寻求律师管理体制改革日益紧迫。我国律师管理体制的改革趋势是扩大律师协会的自治范围,这一过程实质上就是赋予律师协会更多的管理权利,由司法行政机关的管理逐步过渡到律师协会的自治管理。那么,律师协会自治就是由律师组成的律师协会对律师自身事务进行的自我管理、自我服务。律师协会自治权的来源主要是基于宪法学、行政法学等理论依据产生,其自治的内容主要包括制定行业规范、审查行业资格和维持行业纪律等方面。律师制度的建设是现代国家法治建设的重要组成部分,而律师协会自治则是律师制度建设的核心要素。我国目前律师协会自治的过程中还存在尚需完善之处,如律师协会机构设置不健全、律师协会运行机制不完善、律师协会救济机制不科学等。针对这些问题,本文将逐一作出具体分析,根据我国新律师法的规定,借鉴国外律师协会自治的先进经验,克服我国律师协会自治过程中的不足。建构一套完善而又科学的律师协会自治机制是我国律师协会自治有效运行的切实保障,也是促进律师管理体制改革的实际需要,更是法治社会中律师制度建设的核心所在。
[Abstract]:When lawyers develop into a professional group, the management mode of lawyer industry needs to be reformed with the times and constantly improved. At present, the management mode of the lawyer profession in our country is mainly the administrative management of the judicial administration department and the profession management of the bar association, which is referred to as the management mode of "two combinations". With the development of the market economy and the demand of the construction process of the legal society, the number of legal workers engaged in the lawyer profession is increasing day by day. This kind of "two combination" management mode can no longer meet the needs of the huge lawyers' professional team. It is increasingly urgent to seek the reform of lawyer management system. The reform trend of the lawyer management system in China is to expand the autonomous scope of the Bar Association. In essence, this process is to give the Bar Association more management rights and gradually transition from the management of the judicial administrative organ to the autonomous management of the Bar Association. Therefore, the autonomy of the Bar Association is the self-management and self-service of the lawyer's own affairs. The source of the autonomy of the Bar Association is mainly based on the theoretical basis of constitutional jurisprudence and administrative jurisprudence. The content of the autonomy mainly includes the establishment of industry norms, the examination of industry qualifications and the maintenance of trade discipline. The construction of the lawyer system is an important part of the construction of the rule of law in modern countries, and the autonomy of the bar association is the core element of the construction of the lawyer system. At present, there are still some problems in the process of the autonomy of the Bar Association in China, such as the imperfect establishment of the Bar Association, the imperfect operating mechanism of the Bar Association, the unscientific relief mechanism of the Bar Association, and so on. In view of these problems, this article will make concrete analysis one by one, according to the stipulation of our country new lawyer law, draw lessons from the advanced experience of foreign lawyers association autonomy, overcome the insufficiency in the process of our country bar association autonomy. Constructing a set of perfect and scientific self-governing mechanism of lawyers' association is not only the practical guarantee for the effective operation of our lawyers' association, but also the practical need to promote the reform of lawyer's management system, and the core of the construction of lawyer's system in the society of rule of law.
