我国检察监督的几点思考

【摘要】：我国检察机关是宪法所确认的从事专门的、特定范围内的法律监督活动的部门。检察机关的法律监督是对法律实施情况进行的监督,是我国社会主义法制的重要内容,是实现依法治国的重要保障。研究检察机关的法律监督问题,必须对检察监督的概念、性质、地位和价值等问题进行认真分析和研究。本文首先从分析国内理论界和司法实践界对法律监督的内涵的不同理解入手,对检察监督的概念作了明确的解释；对检察监督的特征,即本源性、专门性、强制性和广泛性进行了深入的分析。其次从检察监督的性质、检察监督的手段和检察监督的效力等三方面阐述了检察监督在推进依法治国进程中的特殊地位并从检察监督的本质特征入手,详细论述了检察监督在保障国家法律的统一正确实施和营造法制化社会氛围等方面的重要价值。最后结合检察工作实践,从我国检察权法律监督属性的认识存在分歧、职务犯罪侦查权等法律监督权力的设置和运行不够科学以及我国检察监督缺乏相应保障等三个方面仔细查找了检察监督工作存在的不足和问题,并提出了明确检察监督的法律定位、完善检察权的设置和运行机制、构建科学的制度规范体系、健全保障机制等有针对性的解决对策。
[Abstract]:China's procuratorial organs are recognized by the Constitution to engage in special, specific scope of legal supervision activities. The legal supervision of the procuratorial organ is the supervision of the implementation of the law, the important content of the socialist legal system in our country, and the important guarantee to realize the rule of law. To study the legal supervision of procuratorial organs, it is necessary to analyze and study the concept, nature, status and value of procuratorial supervision. This article begins with the analysis of the different understanding of the connotation of the legal supervision in the domestic theorists and the judicial practice circles, makes a clear explanation of the concept of the procuratorial supervision, and gives a clear explanation of the characteristics of the procuratorial supervision, that is, the origin, the specialization, the nature of the procuratorial supervision. Mandatory and extensive analysis is carried out in depth. Secondly, from three aspects of the nature of procuratorial supervision, the means of procuratorial supervision and the effectiveness of procuratorial supervision, this paper expounds the special position of procuratorial supervision in the process of promoting the rule of law and starts with the essential characteristics of procuratorial supervision. This paper discusses in detail the important value of procuratorial supervision in ensuring the unified and correct implementation of national laws and creating a social atmosphere of legalization. Finally, based on the practice of procuratorial work, there are differences in understanding of the legal supervisory attributes of procuratorial power in China. The establishment and operation of the legal supervisory power, such as the power to investigate job-related crimes, is not scientific enough and the procuratorial supervision in our country lacks the corresponding safeguards. It carefully finds out the shortcomings and problems existing in the work of procuratorial supervision. It also puts forward some countermeasures, such as clear legal orientation of procuratorial supervision, perfection of the establishment and operation mechanism of procuratorial power, construction of scientific system and standard system, and perfection of safeguard mechanism.
