论专业法官会议的功能定位及运行模式

【摘要】：专业法官会议制度存在功能定位不清晰、人员构成行政化、议事范围不明确及程序运行不规范等问题。塑造更适合目前司法环境的制度模式是该制度顺利运行的关键所在。在功能定位上,可限定为提供个案咨询、统一类案法律适用、过滤审判委员会讨论案件。在组成人员上,以学历、专业、审判年限、办案质效等因素综合确定。在议事范围上,将议事内容类型化,减少提起专业法官会议的随意性。在议事规则上,按照行政职务及资历高低确定发言顺序,避免行政压力使领导意志成为"多数意见"。
[Abstract]:There are some problems in the system of professional judges' meeting, such as unclear functional orientation, administrative composition of personnel, unclear scope of proceedings and irregular operation of procedure. The key to the smooth operation of the system is to create a more suitable system model for the current judicial environment. In function orientation, it can be limited to providing case consultation, unifying the application of case law and filtering the trial committee to discuss cases. In the composition of personnel, education, professional, trial years, quality and effectiveness of cases and other factors determined. In the scope of the proceedings, the content of the proceedings will be classified to reduce the arbitrariness of bringing up a meeting of professional judges. In the rules of procedure, according to the level of administrative position and seniority to determine the speaking order, to avoid administrative pressure to make the will of the leader become the "majority opinion".
