论量刑规范化

【摘要】：量刑规范化改革是我国刑事法制发展进程中的一件大事,量刑规范化是一个新事物,其中的一些理论、规则还有待于认真研究和探索。这正是本文选题以及讨论的意义所在。 本文从量刑规范化和相关范畴入手,旨在说明量刑规范化是一种量刑方法的科学化,其与量刑公正和量刑裁量权既紧密联系,又有区别。量刑规范化改革是一项全新的司法活动,量刑失衡也并非我国特有的现象,只是国外对量刑失衡问题较早给予了足够的重视并进行了理论和实践研究,考察国外量刑规范化是为了完善我国的量刑活动。量刑规范来源于实践,我国从2010年10月1日起在全国全面试行量刑规范化改革以来,遇到了各种各样的问题,关注这些问题并加以研究,找出对策,才能不断促进量刑的公正公平。
[Abstract]:The reform of sentencing standardization is a major event in the process of the development of criminal legal system in our country. The standardization of sentencing is a new thing, and some theories and rules still need to be seriously studied and explored. This is the significance of the topic and discussion. Starting with the standardization of sentencing and related categories, this paper aims to explain that the standardization of sentencing is a scientific method of sentencing, which is closely related to sentencing justice and sentencing discretion, but also different. The reform of sentencing standardization is a new judicial activity, and the imbalance of sentencing is not a unique phenomenon in our country. The purpose of investigating the standardization of sentencing abroad is to perfect the sentencing activities in our country. The standard of sentencing comes from practice. Since our country tried out the standardized reform of sentencing in the whole country on October 1, 2010, we have met various problems, paid close attention to these problems, studied them, and found out the countermeasures. In order to continuously promote the fairness of sentencing.
