对《婚姻法解释三》关于夫妻间赠与房产规定的冷思考

【摘要】：《婚姻法司法解释三》第六条对夫妻间赠与房产的规定适用于合同法有关赠与合同的相关规则,该条司法解释忽视了夫妻赠与合同与夫妻约定财产制的区别。我国《婚姻法解释三》第六条规定的情形实质上属于夫妻财产约定的范畴,理应直接适用《婚姻法》有关夫妻约定财产制的规定,排除《合同法》赠与合同规则的适用。因此,夫妻房产赠与的约定只要符合生效要件,就无需进行房屋的产权变更登记,便可直接发生物权转移的法律效力。
[Abstract]:The Judicial interpretation of the Marriage Law III > Article 6th on the grant of real estate between husband and wife applies to the relevant rules of contract law relating to gift contracts, The judicial interpretation ignores the difference between the contract of husband and wife gift and the property system of the agreement between husband and wife. The situation stipulated in Article 6th of the Marriage Law of our country is essentially within the scope of the property agreement of husband and wife. The provisions of the Marriage Law concerning the agreed property system between husband and wife should be directly applied to exclude the application of the contract rules for the gift of the contract of contract. Therefore, as long as the agreement on the gift of the husband and wife is in conformity with the effective requirements, there is no need to register changes in the property rights of the house. It can directly produce the legal effect of real right transfer.
